Not sure they had a duty to anyone. I don't suppose many (any) people were actually paying anyone to use that site. I used it to check out musicians and found it very handy being able to listen to some tracks and then sometimes follow the links to 'friends' sites. Last couple of times I have been on it I have found it to be very slow, so I don't really bother with it now. These sites cost money to run and maintain. Businesses buy them, drawn by the huge number of users but then run into the same old problem; how do you raise money from the site in order to cover the costs of running it, nevermind make a profit from it. Not easy to do when the vast majority of people think it should be free. Remind you of anything?
