sounds like a proto-statistic to me. Let us see if we can enlighten.
Scotland is less populous - try %. Scotland had a ternary murder law. "Unproven".
Before the repeal of capital punishment there was a lot of debate about how "murder" was defined and collected. And the "manslaughter" charge was used more often in the run-up. A sure fire bona fide statistical fact (as in artifact).
Statistics depend on the question you ask. And the answer you choose to elicit therefrom.
I am not in favour of the death penalty BTW. But I did smile at the (then) comment: "imprison them and indoctrinate them until they fully understand the import of their misdemeanour. Then kill them"
