Good questions.

I'm no expert (and I'll be glad to be corrected) but my impression is that the prohibition against the language was on the books for significantly less time that the treasonable utterances statutes.

There are also certainly artistic and poetic reasons--not just political--for refering to Ireland as a little black rose.
