The lawmakers are not the nuts and bolts of the justice system. Due process in the criminal justice system doesn't apply to what's happening here. Whether this attempt in Congress fails or not, Trump could be charged with criminal offences and brought to the normal courts. I don't see much of a constitutional crisis.
