The Fourth amendment says "the right of the people to be secure in their persons," the Fifth says "No person shall be held," the Sixth "In all criminal prosecutions the accussed shall enjoy." None of these protections makes any distinction as to whether the person in question is an American citizen. These protections apply to any person under U.S. law, making no exceptions. Further, "enemy combatants" are protected by the Geneva Accords regarding POW treatment.
