P2P United's executive director Adam Elsgrau said: "We do not condone copyright infringement, but someone has to draw the line to call attention to a system that permits multinational corporations with phenomenal financial and political resources to strong-arm 12-year-olds, and their families, in public housing the way this sorry episode dramatises.""

The fact that every flea market in California has had copied material for 40 years, clear back to 8-tracks, does not make it right, nor does it mean there is anything we can do about it. Our society is willing to spend a moderate amount of money for police services and no more.

Hrothgar - Yes, she was identified by at least three newspapers to my knowledge. It seems a pity that the corporate might of the American copyright police should have chosen to prosecute a kid who was doing what kids do (presumably for no monetary gain) while at most computer fairs and in car boot sales fake, copied, and otherwise 'illegal'material is freely available.

Don't know what happened there.

1. Has she actually been identified?

2. HOW MANY songs??? This kid will be worse than the Mudcat if she is allowed to reach adulthood.

Not that I carry any brief for corporatised music. Once the original writer/composer doesn't own the copyright any more, I'm pretty callous about rights. Mind you, if it wasn't for copyright, the original writer might ever get to sell the item.

Err... where did the 'nursery rhymes' comment come from?? If it was really in the Telegraph it looks like VERY sloppy reporting to me.

Link to story in today's Guardian: Mother settles piracy case
which states:
(the accused) Ms LaHara had more than 1,000 copyrighted songs stored on her computer hard drive. By using the desktop file-sharing programme, the songs were available for other users to copy for free.

According to court papers she had copied songs from other computer users including Madonna's Material Girl, Dido's Here with Me and Paula Abdul's Opposites Attract.

This morning's Telegraph (UK):

The mother of a 12 year old girl who downloaded nursery rhymes from the internet apologised yesterday and paid $2000 tyo settle a legal action brought by the American music industry. [she] was threatened with a possible fine of £95000 per song for illegally copying music from a website.
It was the first of 261 lawsuits brought by the Recording Industry of America in an attempt to clamp down on music swapping on the internet.
[thegirl's mother] said in a statement issued by the Association, "We understand now that file sharing the music is illegal. You can be sure that [she]won't be doing it any more." Her daughter added: "I'm sorry for what I've done. I don't want to hurt the artists I love."
The Association said the girl's computer offered more than 1000 copyrighted song tracks via a file sharing service. Its spokesman said: 2We're trying to send a strong message that the illegal distribution of copyrighted music has conseguences."

I have no problem with attempts to stop breaches of copyright. I have many problems with the public identification and intimidation of a 12-year-old child

She wasn't sued for downloading but rather for file sharing, making recordings available from her to others. THe article I read did not indicate the type of music she was sharing but if she's like other 12yr old's, I highly doubt it was "children's " music.
