On CBC Radio last night they played a Stan Rogers song that may only have been recorded once. If you visit the archive for Sept 8 you will find the segment at the beginning of part 2.

In '72, Peter Mesheau was a 19 yr old, b'casting student at Fanshawe College in London, Ont. While he was there, Mesheau bought a song from Stan Rogers, for a case of beer. For the last 20 yrs, that tape was hidden in a shoebox and forgotten. Peter Mesheau is now the Min., of Economic Development Culture and Tourism for N.B. And, he's found the tape. 6:48

As a radio host, I would never have aired the song without the permission of Stan's estate. Apparently, that's what the CBC did in this case and Ariel Rogers (Stan's widow) is suggesting there will be consequences. The CBC should have known better.

I really don't understand this. Is the problem with the fact it was impolite not to ask her or that she has a right to supress airing of the tape? If she does have a right to control how Mr Mesheau's tape of Stan is used, is it because of copyright? And does the copyright outweigh any agreement Stan might have made with Mr Mesheau?

The problem is that a broadcast outlet has to have the "right" to play a song. Releasing it commercially, generally confers that right. Unreleased recordings a whole other kettle of fish which is why you'll rarely -- if ever -- hear bootleg recordings on the radio.

It almost goes without saying in radio that you do not air unreleased material without permission.

This ***&&&^%%$# GD Stupid feature "clear entries" (what the hell would anybody want that feature for?????) was evidently triggered by accident as my cursor passed over it, & ate a large effort i'd put in this!!! VERY IRRITATING!! I HATE TO TYPE!! I'm lousey at it, do it all day at work & have carpal tunnel from it already. Bah Humbug on "clear entries!"

The Stan bit is at the beginning of Part 2. I've been told Mrs rogers is not subtle abt defending her right to control. I've also listened to the chap's discussion &, on the face of it, it doesn't seem to be evil in it's intent. I'd suggest the broadcaster has more culpability than the polititian in this case??

They probably didn't really make the film. They think they own the rights to the song. They think because a Minister in the government of New Brunswick says (after 30 years!) that it's O.K. to ask CBC to play the piece and claim it's the thing to do, that that makes it a good thing to do. They're in for a few surprises. Stay tuned.

The reason they're "putting it back in storage" is because they have no rights; they're trying to make some publicity over something that DIDN'T happen and they are liable to be sued if they try to do anything with it. The song belongs to Fogarty's Cove Music and I own the copyright! It is certainly NOT the only known recording of Stan doing the song - but if you heard it you must understand why it's never going to be released. It simply doesn't stand up to the calibre that Stan came to expect of himself.

When you use someone's music, you pay something to do that. It doesn't mean you own the music. They (whoever "they" are) got the right to use the music in a video (which may or may not have been made) for a case of Schooner! Which should tell you right there how much Stan thought of the song and whether it would go anywhere. The mere fact that this man (Peter whatsisface) cannot even remember details of where it was recorded should be enough proof that this is just one more attempt by somebody to have a few moments in the spotlight at the expense of a man who's been dead for over sisteen years. If Stan were here, he'd probably be tempted to thrash him! I'd like to smack him!

I've been hearing about this tape for the past few weeks, only NO-ONE, except a reporter (female, by the way) in New Brunswick, has had the balls to get in touch with me and actually discuss this song. The Minister of "whatever" needs to talk to someone who can set him straight about how much of his adolescence he should be dragging along behind him. And he needs a lesson in copyright law!

Post this! I'm sure people would love to see how, once more, folk music in this country can be abused by someone with a little bit of power and not an awful lot of grey matter. No wonder the political system suffers as it does. And the CBC could have been much more appropriate with this, too. But, I suspect they were told that there was a problem with airing this song and decided to just do it anyway! After all, they're dealing with a politician, right? So he must be O.K. I am appalled at the amount of time this man has on his hands.Dealing with guys like this is sort of like "kicking at the darkness 'til it bleeds daylight"
