Richard, You say "ONLY if he" the act "is not concerned in the organisation or management of the entertainment by reason only that he does one or more of the following- " So he is not involved in the organisation if he does none of those things. He must be involved in the organisation to a greater extend than the three exceptions. You are correct that it is there only for the the private events for consideration or profit. I can see no way in which it can moderate any other part of the act even if the courts tried to make it do so.
