This is a message for 'Tootler' in response to their posting about the possible loss of live performance in English Heritage properties due to the new licensing legislation. My first thought is that the performances may qualify for the 'incidental music' exemption (Licensing Act 2003, Sch.1, para 7). It would seem they are just background music, in which case the local authority should be at least asked to consider exempting on these grounds. If you could identify the properties concerned this would help considerably. I have already phoned the events department at English Heritage HQ, and the person I spoke to had not heard of any performance cancellations. Hope to hear from you. Thanks.
