The appellate court didn't "find" anything about Ashcroft except that there were no facts alleged to even allow the plaintiff to claim that Ashcroft knew that people had lied in obtaining an arrest warrant. They DID say facts are alleged that Ashcroft should have known people would, under his existing policies, use the statute permitting the arrest of material witnesses for the wrongful purpose of investigating the person they are arresting.
