I know we have a few people on Mudcat that might be able to answer this. I will be checking things out properly through other channels, but would like to see what you think.

My daughter will be at University this September for the first time. She will be 19 and hasn't been employed.

However, since August 2009, she has been on a gap year in Holland and as such is not working, so it is like being on holiday. She will be returning to the UK August 2010.

She is staying with a family and in return for them providing a room for her to sleep and providing pocket money, she does simple chores that must not exceed (I think 16 hours per week), by law. There are also very tight stipulations as to the type of things she can help with. The Dutch Law provides guidance on all of this and what the maximum amount of pocket money can be paid. She is not on a payroll and neither are the family required to do that or allowed to.

She is in fact an Au Pair which in Dutch Law, is not classed as being employed and is not insured for medical help etc etc.

We have taken out a 1 year travel insurance to cover her for any eventualities. So effectively she is in reality classed as being on holiday.

In order for her to go to University in this country (UK) she is required to have a CRB check as she is planning to go into teaching and some of her degree, will require her to be gaining experience in several Primary Schools over the time of her course.

She has to say where she is living and for how long.

Is being on holiday in Holland classed as living in Holland, or is she deemed as still living at Home?

Does she need to get a Certificates of Good Conduct from the Netherlands?

I am hoping that she doesn't have to do that as it will incur extra time.

Any help from people who know the law will be greatly appreciated.
