Hi Tattie Bogle Regarding unconscious infringement of copyright, George Harrison famously and expensively got his fingers burnt when he wrote My Sweet Lord and the court decided he'd unconsciously based it on He's So Fine by The Chiffons. I don't think he did, and I think that ruling was extremely unfair. I do think it's very likely that the tune of Sam Hall was based on that of Ye Jacobites, though; but if I were judging a copyright infringement case, I'd have given the author of Sam Hall the benefit of the doubt on that, too.
