It doesn't factor at all. This is a completely different set of facts, under a completely different set of laws, occurring in the continental United States instead of outside, regarding actions taken by the military and/or CIA versus actions by US civilian prosecutors (and on and on and on).
The only function of "factoring in" the Supreme Court Guantanamo decision is an attempt to muddy the waters.
