Might be a good idea to go forward. The next time this fellow is involved in an incident, the drivers might not be as lucky as you were. My wife serves on the local volunteer ambulance squad, so she has front row seats to all the accidents. We really have an appreciation for just how hurtful inattention and driving incompetence can be.
