These did not correspond with my understanding of either situation, so I rechecked the various news media sources that I follow. Since the individual responsible for investigating the outing of Valerie Plame has not issued a final report, it is premature to say that Rove had nothing to do with the CIA leak. The definitive report may or may not agree. Likewise, since an indictment has been issued for Mr. DeLay, which indicates that the motion to dismiss filed in Travis County District Court by his legal team has been denied, the court at least disagrees with the statement that Delay's nemesis, Mr. Earle, has no evidence to speak of afterall. As you say, an indictment is not an indication of guilt (or innocence).
