'Eminent domain' has been successfully claimed for years. In the '70s, a friend of mine lost some of his land alongside a highway because the state wanted to create a bigger buffer at the intersection. He, as is usual, got paid for it but the land grab was against his wishes.

What really irritated him is that the state never got around to creating the road change.
