I listened this morning to the story that a lawsuit may be taken out against Cliffe BS. Naturally no-one plans to get injured and one can feel compassion to this person.
However
My observation is this: Since all statutory and commonsense safety obligations had been met the only remaining factor is a pure accident. The person chose to be there and was unlucky enough to suffer the consequences 'that life is not without risk'. Since the risks are apparent to even a casual onlooker, and this person was not casual, it follows that they accepted the 'remaining risks' of attendance or they should have left the area.
