What I don't understand is what this prosecutor is going to charge him with. From what I can see the only thing they can say is that there is a picture that exists of someone who looks like Phelps holding something that looks like a bong. No possession, no DUI - just a picture of possible past behavior. As far as I know that's not a crime.
