Google Book Search finds many copies of GUILTY OR NOT GUILTY printed in various books and periodicals. I looked at several of them; none identified an author.

The earliest I found was in The Latter-Day Saints' Millennial Star (Liverpool: L. J. Herrick, June 23, 1874).

It seems it was always called a poem or recitation, not a song.
