I don't think anyone's argued that McKinnon isn't fit to plead. He seems perfectly lucid in this interview, even when he admits posting messages on US government systems; "I said US foreign policy was akin to government-sponsored terrorism and I believed 9/11 was an inside job. It was a political diatribe."
I haven't heard anyone saying that Abu Hamza shouldn't be extradited, even though he has genuine health problems.
It's the law, pure and simple. OK, it's a poorly-drafted law and one which should be changed, but the change has to come from the legislature.
