Looking at the pictures of both boats, I'd say it was a miracle that no one got wet earlier. Putting passengers that high would really have messed up the center of gravity of the boat. All it would take to make the boats unstable would be for the upper deck passengers to move a foot or two to one side or the other. That would also explain the caveats mentioned in the auction.
