It's kinda like a tax and it's kinda like a penalty. The Supreme Court thinks it's more like a tax and is Constitutional under the taxing power of Congress.

But it isn't precisely a tax like other taxes.

Labeling it as simply one or the other just confuses the issue.

And who on earth would want to do that?
