Trump planned the crime and chose the criminals to participate but he only drove the getaway car. Ergo he is an accessory before and after the crime. I think this charge of accessory will stick if others do not. His inaction DURING the crime is by statute also a crime but Joe Six Pack could find it hard to convict someone for doing nothing.
