The Supreme Court has ruled that the President cannot legally be considered an insurrectionist, because he has not been convicted of insurrection in any court of law. He is innocent unless and until proven guilty.

And because he is a sitting president, elected by the people, he cannot be brought to trial now.

So that's that. DJT is President under the Constitution.
