"Sir Keir has reinstated the May 2026 Council Elections"

According to the BBC radio news, this is because they've received legal advice that the delay was illegal.
Is this new advice, with the case due to be going to court later this week?
Or is it advice the Labour Party already had, but thought they could get away with if no one questioned it?
