Technically, the newspaper has the "right" to refuse to deal with whomever they choose. The problem here, is that they are refusing to deal with writers because the writers filed and won a meritorious lawsuit against the N.Y. Times for cheating its writers. So this is an instance of retailation which seems to contravene public policy. Probably it's not illegal - but it should be.
