The Constitutional arguments regarding all of the Bill of Rights are completely tied to interpretations of the document in regards to the time it was written and whether or not that stricture should be considered.Take any of the amendments and you'll find people on one side of the issue using the "times" argument IF it suits their purpose. What I find most interesting is that the same person may argue it as being relevant on one and not relevant on another.
In the final analysis the Constitution is interpreted by politics and money......and that's just the simple fact. Arguing the "right" of any Right under that condition is an exercise in futility at best and more like mental masturbation.
