I'd like to take this statement of Ebbie's and make a slight modification to it:

Let's put it this way: Say there is a heinous murder. We can't find the guy who did it, so we execute another bad guy (and many of the innocent people who live in his building) for it even though we know he did NOT perpetrate this particular murder, and it does nothing to stop the guy who got away. Is this defensible?
