If I recall correctly, French and English succession law differed, and it was only by English law that Henry had any claim to the throne at all, much less the stronger one. Further, Henry had not been crowned the King of France by the ecclesiastical authorities of France, nor of England. In short, it wasn't his territory by law or by possession.
