I wonder if anyone can help with this question, please? All informed responses - maybe from your own experience - gratefully received. This relates to a non-Mudcatting acquaintance, not me personally - I'm just trying to help.

As I understand it, if I release an album in the UK that is mainly traditional, but includes a couple of cover versions, I can submit the relevant form to MCPS who will bill me for the 8% of dealer price in respect of the covers if they are of songs by MCPS members. So far, so good.

However, if I was to then to send the album to CD Baby in the USA to sell on their site and distribute to their digital partners to sell via download, would I have to get separate US clearance in respect of the cover versions or would evidence of UK clearance via MCPS be enough? Though CD Baby provide lots of helpful info for US based artists about dealing with copyright clearance, it is unclear if this also applies to overseas artists using their services - and as they say, their role in the area of copyright is to provide useful advice rather than comprehensive information about all possible situations: they are very clear that it is the role of the artist to obtain any necessary clearances before making their album available via CD Baby.

Can anyone offer any solutions or ideas?

Or failing that, does anyone know of a decent copyright lawyer or specialist who may be able to offer one-off advice for a reasonble fee?

Check the exact terms of teh MCPS licence: I think it suffices. MCPS will be able to tell you - but when they have told you, check the licence.

I put two of my albums, which had been cleared through MCPS first, on CDBaby without needing any additional clearance. I had to provide the UK barcode, if I remember right, and that was all - they seem to be able to link through the barcode and find the MCPS licence.
