I started listening to a recording from the mixing desk of Richard Shindell's 16/03/11 gig at The Ark, Ann Arbor (USA) this morning, and the presenter announced that "you can record if you want to, but let Richard have a copy"!!

I think it's a great idea to formerly announce this at the start of a gig.
