Today I found that the tracks from my 1968 album Queen of Hearts are being sold on Amazon through a company called Lumi Entertainment - who have put the release date of the album as 2011!

I know NOTHING about this company and I've certainly got no contract with them, nor have I been paid any royalties.

Does anyone know anything about the Folk Heritage label being sold out from under the feet of the artistes concerned (boy what does THIS remind you of?) and without even the courtesy of letting them know?

They seem to be selling a lot of downloads on iTunes and Amazon. No website but Iceni Records has a MySpace page that appears to be unmaintained.

From StreetView the address is either a accountant's office or another office above it.

NB Before anybody posts to say that Amazon.co.uk have removed the tracks they are indexed under "Rosemary Hardman" not "Rosie".

Thanks for that to both of you and for the trouble taken - much appreciated! Unfortunately that's as far as I got too - no contact number or ANYTHING. Amazon just said that they always check that people have the rights to the 'intellectual property' that they post and refused to be any more help - thanks to the good old Data Protection Act - that seems to protect anyone EXCEPT people who NEED to know things!

I found that address too but just wondered if anyone knew anything about this takeover of the Folk Heritage catalogue?

We are DELO'Music Entertainment Publishing Administration Group, LLP (DEPAG, LLP), publisher and copyright owner of the catalogue of the Robert Higginbotham/Tommy Tucker estate. Since requesting documentation for proof of claim by claimants, whom are numerous, from 1992 until present time, we have been omitted from the payment process for the licensing and use of our works by the major publishers and independent publishers alike and have come upon your posts following the trail of Lumi Entertainment, whom has not paid royalties for using our works, DEPAG, LLP finds this on 85% of the aggregator sites accessed. We are looking for the enforcement arm that enforces these alleged infringers to comply with the U. S. Copyright Office's legislation for protection. Would anyone know who the enforcement agency is assigned to that task. We have contacted the U. S. Government's District Attorney's office, yet, have not gotten a response from anyone there. Any assistance would help greatly in communicating with someone who protects songwriter's rights. Thank you!

Sadly there are a number of people, according to the web, who are not getting paid anything by this company. However all attempts to contact them fall on stony ground. Amazon know full well who they are paying but they won't give me any details thanks to the Data Protection Act.
I would write to the Mechanical Copyright Protection Society in the UK    (who work with the Performing Rights Society). They don't deal with copyright problems in the US but they are almost CERTAIN to know who does. I hope that helps!

I belonged to the band Gallery who recorded the album 'The Wind That Shakes The Barley' with Folk Heritage in 1972.
I have only just heard of the co. Lumi Entertainment/Iceni & that it is supplying downloads of Recordings to Amazon & others.
I can tell anyone who is interested that, if tracks from the above album are supplied, I have no contract with them and have not received any royalties, nor have other surviving members of Gallery.
I hope that someone with more knowledge of the law will persevere with this matter.

I am a member of Folkal Point, we'd recorded an album for Midas Recordings ( an off-shoot of Folk Heritage ) in 1972.
Notwithstanding the notoriety of available copies of the original vinyl, I have noticed that the album is commercially available through sites like iTunes, Spotify, Googleplay, etc.
I have only just seen the name Lumi Entertainment.
I do not know this company and nobody from the band has ever signed any agreements with them.
We have never received any royalty payments.
I seek to register an interest in order to legitimately claim such as would be due to us.

During the last few hours I've managed to discover that the entire Lumi Entertainment Ltd. revenue stream was sold in January, 2014 for £75,000 - to: One Media IP Group PLC.
I would suggest that none of the Folk Heritage/ Midas Recordings artists have ever entered into any agreements with Lumi.
I have contacted iTunes enquiring how to register an interest and have entered into e-mail correspondence with Spotify, making them aware of the position we now find ourselves in.
If we are able to register an interest with these service providers, we just might receive some recompense.
This is a terrible state of affairs, equating to a sense of theft.

I've just found a little more to add to the backstory.
It seems that following Alan Green's death, Simon Jones of Northern Record Services Ltd. acquired the entire catalogue of master recordings on the Westwood, Folk Heritage and Midas Recording labels.
Obviously, there was then some kind of gap in the story.
The entire catalogue was then sold outright in 2010 by NRS Ltd. to Lumi Entertainment Ltd.

This seems to lay dormant for long periods, a flurry of activity is then eclipsed by yet another dormant interlude.
Who is Simon Jones/ NRS Ltd?
In the case of Folkal Point, I have been told that no master tapes survived.
The inference being, that tracks offered by Lumi could only have been lifted from vinyl.
I'm aware that Paul Adams ( Fellside Recordings ) has done something in an attempt to protect Rosie Hardman's interests.
I look forward with great interest to any additions to the facts of the matter.

There is now another player in the game - a label trading under the name of Zeitgeist has released a CD re-issue of Folkal Point - claiming copyright since 2015.
The audio quality of the Zeitgeist product is truly awful.
Who are these people and what gives them any right to do this?
We have registered our tracks with PRS and PPL - notifying them of these rogue traders.
I await some outcome.
