I would like to re-record a song released on Columbia 14324D - Recorded 3-20-1928 NYC New York - Bessie Smith On Vocals.
"Put It Right Here (Or Keep It Out Of There)" Words & Music By Porter Grainger.
The song was featured in a live musical Broadway show, "Me and Bessie" in 1974-5.
Maria Muldaur released it on a recent album "Richland Woman Blues".

I would like publisher and date in order to get the rights to re-record this song.

P.Grainger is not affiliated with ascap, and Harry Fox doesn't have this song.
BMI, SESAC, no luck
I have searched the internet for more details but this is all I have.
Playbill of the Broadway show listed publishers for many songs but not this one.

It's not Public Domain yet, I think it has to be before 1923 and this is 1928.
Any help would be appreciated.

The small print on the front page at mudcat includes "We are not a copyright resource." Suggestions are not legally binding.

Have you inquired into how Muldaur was able to record it?

Songs like this are always tough. Very often you end up paying royalties to some company that has no legitimate claim on the song. Either that, or you just take a chance and record without licensing.
Let us know what you come up with.

If you can post the lyrics and what you know about the song, that would be very helpful to all of us.

This one got caught up in the electro-revival movement a few years back. "The Worldstylers" practically made a side-career out of just the sampled remixes:

They got a nastygram from Sony Music Entertainment but I don't know what ever came of it. They've never attempted to block online sales that I know of. Sony does have the Smith original up on youtube now with the usual "All rights reserved…" boilerplate attached.

Smith reissue with Sony notices.

Sony owns Columbia, so I am sure that Sony owns the rights to the Bessie Smith recording. However, that does not mean that Sony owns the rights to the song itself. I have had a lot of trouble finding rights to songs written by black songwriters in the 1920s and 1930s.

Acme, it is true that Mudcat is not a definitive copyright resource. However, many of us enjoy doing copyright searches, and we are pretty good at it and have a fair amount of experience. Readers should be aware that they should check documentation supplied in Mudcat posts, and not use a Mudcat post itself as documentation of copyright.

I am re-entering it here:

According to the official records, Grainger copyrighted that song on July 12, 1928. Under copyright law of the period, he would have had to re-register the song after 28 years (after which it would remain "protected" for another 28 years), or let if fall into the public domain. So, the question is, did Grainger re-register the copyright in 1956?

It is unlikely, as he probably died before that date. Still, he could have passed the rights along to someone else. You can scan song copyright for that year by using the search term "1956 catalog of song copyright." The Library of Congress has made these records public, and you can either search them online or download them as pdf or doc files. My own search reveals that only two songs were copyrighted be a Grainger that year, and both were by the composer Percy Grainger. My opinion, therefore, is that this song is in the public domain and you can feel free to use it. Of course, you will probably want to do your own search first.

fwiw: Grainger was the musical director for Smith's entire show. The Wiki gives his year of death as "c.1955" but I'm pretty sure the whole page is taked from the U.of Kentucky bio:

...which gives it as 'unknown.' Also be aware, sometimes the family dropped the "i" (ie: Granger.) If anyone improves on the date(s) in their searching please do post it here. tia.
