Subject: copyright permission for pittenweem jo From: GUEST,mg Date: 02 May 21 - 05:03 PM I have been unsuccessful in contacting anyone for permission to use Pittenweem Jo in upcoming cd. We are in the final days for assembling the music. I understand the current copyright holder is not in good health now. Should I abandon the hope of including this? Can anyone give permission for it to be used? I would gladly pay the copyright fee. There are literally about three days to solve this. Should I go ahead and try to sort it out later? There is no money to be made in this cd..just break even about. |

I have had various experiences re permission for use of songs in the US. Some users are keen to press money on me, some do not even think of getting permission and just keep the money. I sadly have come to the view that if it is not in anyone's ability or strong interest to pursue an abuser in the courts the baddie will get off with it. Ewan |

I checked on the MCPS website and I found this info: Pittenmweem Jo MCPS Tune code: 0164993C Composer/Author John Leslie Watt Publisher: Neon Music When Jim and I use someone else’s song on a recording we get a license from MCPS and pay royalties to them, which are then forwarded to the copyright holders minus MCPS’s commission. I don’t know what the process is in the US. I hope that’s of some help. We knew John Watt – he was a really nice person, always very ready to laugh. He wrote some great songs and we sing a couple of them quite often. The last time we saw him we joined him on an old wooden bench he was sitting on. It collapsed under our combined weight and we all rolled about on the grass laughing. It’s a very happy memory. In my experience, sensible songwriters would quite happily give permission for use of a song on an issue of 500 or less. A publishing company might not be so generous, but IF you are in USA or outside the jurisdiction of the UK, I'd just go ahead and do it. |

In the UK the MCPS charges 6.5% of Retail Price x number of copies made. That's for the whole CD and is split between all the tracks. You don't pay for tracks which are non-copyright. A run of 500 CDs to be sold at £10 each would cost £325 assuming all the tracks were copyright. Assuming 12 tracks of equal length, that's £27.08 per track. However for that number you could get a Limited Manufacture Licence for £163.40/£13.62 per track. Different countries may have different rates but it still sounds a lot to me. Did you provide the website with information on all the tracks on the CD or just that one? |

If so, they won’t check if you tick the box saying you have permission, as legally it falls on you, not them. So, it is possible to just go ahead and do it. It is a lovely song and there is room at least on the disk for it but i am stuck and can not produce through cd baby without a permission. now please don't be rude. at this point, barring a miracle by tuesday, it is not on the cd. i do recommend that people listen to it as it is a wonderful song. |
