Subject: Does it matter who wrote the song?
From: Johnny J

My short answer is "YES"

Basically, I would like us to discuss the fact that many song (Applies to tunes as well) writers are not given the credit for having composed certain songs which have been popularised by others or even, in some cases, mistakenly believed to be traditional.

I'm talking about more informal scenarios, e.g. gigs, courses/classes, sessions, and even one of my local ukulele groups where "San Franciscan Bay Blues" is attributed to Eric Clapton.

A good few years ago, I was listening to a band in a bar and they played "City of new Orleans" which was, they said, an "Arlo Guthrie song". Of course, he does a great version but it was originally written by Steve Goodman.
I mentioned this to he singer at the break. He said "That's good to know but I'll still keep saying it was Arlo Guthrie"   ;-(

Of course, there's no harm in giving Arlo credit as he helped to popularise the song but the original composer should not be ignored either.

So, while I'm not against relating the circumstances of where you first heard a song e.g. from the "singing of" or "recorded by", if you know the name of the original composer then he or she should get a mention too. It's only fair. Especially so, if you are performing these in public or distributing song sheets and/or teaching in musical groups or workshops etc.

I'm not averse to pointing these discrepancies out from time to time, as many will know. ;-))))

Indeed.

I just remembered today that Freight Train as recorded by Nancy Whiskey and The Chas McDevitt skiffle group was credited on the record label to "James -Williams" . I checked my 78 just now.
Apparently, this was made up by McDevitt and his producer/manager(?) so that they could claim the royalties!

Apparently, Peggy Seeger learned about this and started a legal battle on behalf of of Elizabeth "Libby" Cotton who actually wrote the song.

By all accounts, such practices were rife back. So, don't even believe everything you see on a record sleeve either.

For the record, it's "Libba" Cotten. -Joe Offer-

Digital distributors and streamers have demoted the role and credit of songwriters, due to inconvenience and chasing priority attention clicks. We live in a Karaoke world, where they promote the artist first - and anything to do with the song the person is singing comes way down the list. If you type in a Google search, you will see the search page results headed for Spotify as "Song and Lyrics by", no matter who actually wrote it. For Example Yesterday Song and Lyrics by Marianne Faithful. It is only when you enter the site that you get deeper level info. and even then it is often wrong, or truncated. That happens with TikTok and other platforms.. they also give out tracks for video shorts with no authorship/composition data - only the artists and song title. Nobody bothers, it is just taken for granted. I have tried to bring this up with songwriting organisations, but they are toothless and obsessed with the streaming rates - not the moral rights of songwriters.

It has happened to me a couple of times with respect to traditional songs, but to be totally honest, I don't care.
A well-known singer recorded a tune I had written to a traditional song, and I hope he made a fortune from it. Best of luck.
Two characters in the remake of Poldark wandered across the screen singing a traditional song to a tune I had remodelled from the original. I am not remotely interested in chasing anybody for money.
Enough is as good as a feast; I am fed, and the bills are paid.
I felt the same way when I was 24, and I am now 74. Life is a lot less stressful with this attitude, IMHO.

if someone has composed words and tune, it is not entirely a question of money, but also recognition of creativity.
as regards the financial aspect it depends on the actual situation if the performer claimed it to be his own composition and it got to number one, the degree and intent is considerably different from someone who inadvertently records a tune that someone had written to a traditional set of words, and presumably the financial aspect is different, in the first case quoted by Nick Dow, the singer ought to at least acknowledge Nick [ if he she is aware of the situation.]
I hope it was not me, if it was my apologies

Yes, he did acknowledge it when he found out. I did not tell him. I was happy to hear him sing it.
Of course Dick is correct. If I were a songwriter and it got in the charts (much the same as the late Barbara Berry), then that's a different kettle of fish. Do you know, even then I'm not sure how bothered I would be. Anyone who knows me will be aware that I am the least money-oriented bloke they could meet. I've always found enough! Something comes along or drops out of the blue. I stopped worrying years ago.

I'm little known as a songwriter but a number of people have asked for my songs. I'm always pleased about this but it does annoy me a bit when friends tell me they have heard my songs performed in public without any mention of me as the writer.

PRS (the Performing Rights Society) has a database of songs where their members can register their works and claim royalties when they are performed. However for some reason it is only accessible to other members. I don't understand why, because most performers have no need to join PRS but might nevertheless be interested in who wrote the songs they perform.

It's about provenance as well as authorship. For example, I often I hear 'Dirty Old Town' referred to as an Irish song or a song by the Pogues. Certainly it's a song with a universal social perspective but I think it's worth knowing when and where the story was set. Likewise 'Fiddlers Green'; I imagine it must be rather bitter/sweet for John Conolly knowing that his song is widely thought of as part of the traditional heritage of a number of different countries.

Hard to do without a break between each-every song. Not good for many audiences/venues/genre. Doesn't matter to me.

Getting it wrong is a different story. Ordinary, sloppy work has always been a fact of life and hardly unique or exclusive to music. The publisher bots do test one's patience tho.

And then there's the out-and-out, for profit, intellectual property theft. That does matter to a whole industry of folks.

Yes, we had the “Irish song” (Dirty Old Town) introduced as such on our outdoor stage at a certain festival a few years back. Several of us were saying “Salford, Salford” from the back row. I spoke to the singer privately afterwards, and he said, “Well everyone one thinks it’s Irish”, to which I replied, “Sorry, but no they don’t”.
Then there are tunes and songs which people think are traditional, but are not, e.g. Thomas Walsh’s “Inisheer” and Jim McLean’s “Massacre of Glencoe”. Some would say it’s a compliment to the composer to have them thought to be traditional, but it’s not if they don’t get their royalties.
As for incorrect attributions on YouTube, Spotify is even worse. It’s always “song BY” whoever happens to be singing it. And how often do YouTube posters of album tracks mis-spell their titles? You’ve got the original in front of you, so why not just copy the title, letter for letter?

3-4 songs in an unbroken set or medley. There is no "between." One could run down the whole list before or after I suppose. Never heard anybody even try, but that's just me.

Caribbean club music has a "big time" "small time" custom of main acts bringing new talent up on stage for one or two numbers. The focus is on the artist not the song(s.) One wants so stick with the "standards" anyway so the people can compare to something familiar.

Otoh: I've seen acts re-re-re-tuning and sorting their stage kit betwixt every song long enough for a discography, biography and maybe a Power Point slide or three.

"Hard to do without a break between each-every song. Not good for many audiences/venues/genre"

With our kind of music, a break between each song isn't much of an ordeal. Not for the audiences, venue, nor genre.
In fact it is usually expected and welcomed. Of course, performers sometimes will do two or three in a row but they usually either pre or back announce them.

Even in larger concerts, performers usually do this. Maybe not so much with modern beat/club/techno (or whatever the modern trend is now) but in most other genres. Classical concerts etc even provide a programme.

Occasionally, some songs are so well known and/or associated with the artist or band that no introduction is considered necessary. The audience usually accept this and there is no issue.

One pet peeve with some of the "tune" bands is that individual tunes are sometimes not mentioned even in track listings on albums but, as long as they are detailed in the smaller print that's probably OK too.
Such bands have a tendency to name each track either after the first tune, some specific "in joke" or story or as in the case of traditional dance bands after the actual dance set. Many possibilities.
All that aside, this discussion is mainly focused on songs rather than tunes.

Johnny J: Your music is what I was thinking of in my last paragraph.

American bluegrass bands are the slowest. The bigger, the slower. It's really, really, really not a problem to give credit where due.

I don't think I've ever attended a classical performance not knowing the entire program well in advance.

Don't expect much from your average Texas roadhouse once the place gets jumping.

My Caribbean club music runs to Monty Alexander type lounge jazz. The jams can go on for a minute. We're not too fussy about it really.

I think that the lack of attention given to the background of tunes is also partly why some tunes now have multiple names.

We talk about Elvis songs, Cliff songs, and Beatles songs. Only the latter have composed the bulk although no means all of their own material.
Many will associate "Twist and Shout" with The Beatles, for instance. Not me personally as I'm old enough to have been around before that. ;-)

Lindsay Lou has a video where she talks about this. The song “I Only Exist” typically gets attributed to Ralph Stanley when it was actually his wife Jimmie and her friend Joyce Morris who wrote it, and how who’s singing it and who it gets attributed to does change something about it.

Anyway, I think it’s obnoxious not to acknowledge people. I wrote a melody to an old poem from the 19th century, and though it’s long been in public domain, I always make sure people know I didn’t write it when I sing it.

https://m.youtube.com/watch?v=m4JAgHNXeQ8

There could also be a case where anonymity is suggestive of antiquity and antiquity of stature, and perhaps in certain folk music circles, not claiming a song as your own may lead to more respect as opposed to saying you wrote it.

Agree with Tattie and others that it is rude to say "BY" the famous recording artist when there is a perfectly good human, often still living, who wrote the song. On stage, either don't say who it's 'by' or acknowledge the real source, in print you need to take the trouble to find the author(s).

I know everyone here detests karaoke, but after doing a lot of it, I can see how people get in a habit of saying 'BY famous artist', because when the karaoke jockey is looking up your song, they need to know which version you are after, and those are stored by 'Artist' not composer.

But that's random amateur singers. If you are a performer or webmaster of a music related site, then you need to do better.

Auto-translate is a new source of muddle. I took somebody to task on another forum for saying they were playing "Greensleeves on the ground" - it's "Greensleeves to a Ground", and the title tells you something relevant. But it turned out they'd titled it correctly in Japanese and auto-translate messed up.

The possibilities for assertively authoritative AI-powered bollocks in liner notes will not be fun.

Regarding Johnny J's post. I agree, though in those days the writers of songs for the likes of Elvis and Cliff etc were sometimes unknown professionals, particularly unknown for us in the UK as many were American. Their only public acknowledgement was on the vinyl disc underneath the song title and artist name.

I remember, aged about 10, looking at one of my older brother's discs and reading the names Goffin/King. I think I was well into my teens before I realised who 'King' was.

“By”

Merle Haggard is/was industrial country-western. 1960's Los Angeles recording studios were 24/7 insane asylums. Time-is-money, go-go-go, &c. The in-studio talent were all A-list - 1st call pros. Musicians routinely doubled as uncredited co-writers & arrangers. (Hal Blaine, Glen Campbell, Carol Kaye &c &c.)

The live act would typically retain only Merle Haggard. The stage & studio bands were both billed as The Strangers but the 'original' in-studio musicians had long since moved on to their next sessions.

I don't recall Haggard giving any credits on stage beyond the usual mid-show band intros. In terms of production stream, he was closer to The Monkees than The Beatles or Stones.

Learning the truth about Franklin W. Dixon was like learning the truth about Santa Claus, Easter Bunny & Tooth Fairy for some young consumers ;)

I have seen Ewan MacColl's FIRST TIME EVER I SAW YOUR FACE credited to Roberta Flack.
Then there's Dave Van Ronk's version of RISING SUN BLUES, which was recorded by Bob Dylan. Dave quit singing it after people started requesting "that Bob Dylan song". Eric Burdon learned it from Dylan's first LP and when people started asking Bob to play that "Animals' song", Bob quit singing it.
While Van Ronk had an original set of changes, Many folks had sung it to different changes before him. Josh White, Woody Guthrie, Lead Belly, Joan Baez and many others recorded it years before Dave Van Ronk, Bob Dylan or The Animals.

Alan Price, the keyboard player for The Animals, got credit as the arranger rather than the writer because "House of the Rising Sun" is a traditional folk song of unknown authorship. Price took the arranger credit on the record label, which legally gave him the sole composer's royalties.

According to Burdon, this was simply because there was insufficient room to name all five band members on the record label, and Alan Price's first name was first alphabetically. This meant that only Price received songwriter's royalties for the hit, which has caused bitterness among the other band members ever since.[

The Atlantic Ocean for one...

U.S. publishing does not control retail "product dress" nor does said dress control royalties. Alan Price, The Alan Price (Rhythm and Blues) Combo, The Animals or their reps would do the formal paperwork and there is no limit to the attachments and addenda.

That's how Weird Al's team got Gansta's Paradise with both Coolio (RIP) and Weird Al out of the loop. Left hand-right hand and the $$$.

Mike Nesmith could "parody" his own Different Drum because John Herald (Greenbriar Boys) took it before Nesmith's (The Monkees) own producers. And by the time Linda Ronstadt's (Stone Poneys) suits got done with it... no Stone Poneys. You're hearing Linda and the Wrecking Crew du jour.

Just another Tuesday afternoon in La-La land.

Thanks for all the responses.

The discussion has been widened a little which is perfectly fine.

While I was initially thinking about more informal and relatively "low on the radar" instances of this issue, I do understand that what happens in the general "industry" itself and at higher level has a great deal of influence on how things happen on the ground.

Unfortunately, many people who listen to and play music or song often just blindly accept everything at face value or just don't bother enough. That's a shame, I think.

The fear of flying was AP's excuse for leaving the Animals. Fair enough. However, I fail to see how that would hinder him in ensuring the rest of the band got their due share of the royalties for the HotRS arrangement.

As I suggested, it would be interesting to hear his side of the story.

Referring back to my comments earlier about the degradation of songwriting credits and general kudos to writers.. we live in a karaoke world. Generations have now grown up with the 'cover of'.. syndrome. The recording artist or whoever made a work famous get the kudos. Not that many people bother about the origins of songs or research them..they just post them on social media (which is why I valued this site_. In pop music we sometimes have a dozen writers.. In folk we have cultural appropriation for marketing purposes.. So a Scottish song will be marketed as an Irish one to make it fit in.   Local radio DJ's used to give the occasional plug for local niche genre writers.. when they had those solid bits of vinyl or cd's before their eyes. Not so much now.

Re: Sol's "due share"

Is still defined in the formal U.S. paperwork, not a 'court of public opinion.' Entertainment fans do love their gossip tho. Sorta comes with the territory.

On a less drifting note, live folky-folk performances move slow enough that the choice is between giving proper credit and a joke, a story or dead air.

The jokes should be funny; the stories enthralling and... for Paul Campbell & Pete's sake... get your music-business history sorted beforehand. It's not a big ask.

Connected to my last comment, sometimes artists unintentionally spread false information to an audience..    I was watching a local group called 'Tartan Paint', go into a spiel about the late great Scottish accordion player Fergie MacDonald.   They made a big hoo ha about songs he wrote (he wrote instrumentals).   They then introduced Fergie's one big vocal 'hit', 'Loch Maree Islands', saying it was his famous song.   Only thing is, he did not write it. He was the first to record it, and it was in fact written mainly by a Kenneth C. Mackenzie, and nothing to do with Fergie MacDonald as a writer. I spoke to the band afterwards, but I didn't have the nerve to correct it, as I wasn't sure if they would think I was a know all and offensive, correcting their well rehearsed trotted out spiel.

Re: Music, lyrics, publishers & proper credits per release.

Listen first (no ytube!,) then write.

Many (most?) U.S. mechanical rights (that fine print under the media's song title,) will give the lyricist(s) full credit for an instrumental. It's about sharing the $$ and the Animal style problems one reads above.

I've heard the 'Caribbean' folk classic Yellow Bird claimed by every island south and/or east of Miami. Arthur Lyman's so-called "English" version is actually an exotica-instrumental lounge classic. Alan & Marilyn Bergman's contributions are totally absent there.

The Harry Belafonte 'original' doesn't even exist. Doesn't stop the voluntarily deaf 'expert' from giving credit for the "English" either.

Actually, and regrettably it's probably going to become somewhat irrelevant, since AI can now "write" a song, in any style, on seemingly any subject, so whenever someone introduces a song they've "just written", one is going to wonder how much of it is actually original.

Not good for creativity...

Similarly with novels: there was an article in the press recently that second-hand booksellers are suddenly getting orders for huge numbers of old books to be sent to all sorts of places, it's thought to be used to "teach" AI to write novels. (Then, it is reported, the books will be pulped).

This is going to hurt genuine authors and songwriters alike.

I’ve told AI to write things in my style. It’s turned out awful and nothing like how I actually write—back when I was experimenting with it. I am not touching it these days.

There's hope: methinks this river of (to use the trade term) slop will dry up once the perpetrators of Artificial Incompetence run out of financial suckers and have to start charging a rate that will return them an actual profit. But that's an argument for a different thread.

Re AI. Check out the Boy George pro Israel protest song 'We Will Dance Again' debacle, originally most (if not all written by AI) Initially Ai slop recorded, with no humans on it.   Boy George has backtracked by claiming copyright on both words and music, despite previously saying AI wrote a good portion of it. He got bumped off Bandcamp, not for political reasons, but he was spamming them with AI tracks, and at the same time claiming he wrote this and other AI songs (which would otherwise have little copyright as AI creations).   Anyway, there is a pushback starting on the AI slop which has devalued songwriting.

So (to get back to the Subject) it *does* matter who wrote the song. Since LLMs are plagiarism machines which riff on their entire training set, nobody can know who actually wrote any songs they (ahem) extrude, other than it's certainly not whoever wrote the prompt.

End of rant. We apologise for this interruption.
