Schedule Update:

I intend to put these issues if I possibly can this weekend.

This means I will then publish the final contents list with any subbing or replacing due to permissions issues. This listing will also go to michaelr for inclusion in the slipcover art -- which BTW I hope will have some artsy differentiation based on the disk names I mentioned above -- color bars or flower images or some such. I leave that to the artists in our midst.

If anyone is sending me an additional tune or a replacement tune SEND IT TONIGHT!!!

This means there may be some last minutes scrambles for permissions checks if Angel Sorcha is up for it.

If you have been asked to check with someone for okay to use (KEndall, Morty, etc.) please get a response to me as soon as everly possible. (Everly POssible was the 3rd Everly brother, the one with the tin ear...)

I am happy to report that as a result of a LOT of HErculean searching by our own Sorcha, we have reduced the number of songs which have problems on the permissions front to a small handful. I'll get a list out tonight. Sorcha really came through in the pinch over the weekend and should get a medal!

Since we can't use songs unless they are (a) permitted or (b) in the public domain, the options mentioned above will apply to those concerned. (See 23 Oct 02 - 09:01 PM)

Good news is this is a smaller issue than I feared! THe majority of songs are known trad or written by the performer or someone known to him.

That $2 fee for an online license is new since I did my licensing last year. Guess they found another way to pick up a few more dollars beyond the statutory rate. Anyway, it's quick and easy, not all that expensive to legally cover your use of someone's song, and you get the license back online within 48 hours. I used HFA for my Gillian Welch tune.


Another song requiring license - Man in the Middle, by Harley Campbell - was not handled by HFA. You need to look songs up on their website http://www.songfile.com/, where you can also continue on to do the licensing.


When HFA didn't work out, I ended up having a nice correspondence with Harley about his great song, and he directed me to Paul Craft Music, which owned the publishing rights. This led me to an outfit called Copyright Management Services, which had a website called copyright.net. They required paper back and forth, but did the licensing at the same rate. Lately, however, this copyright.net site doesn't seem to work anymore. Interesting, but definitely a tangled web.

Fox also charges $2.00 to process even an online license. For one point of view, it's little enough. But from another it is really a pain in the old zorch! :>)

One more thing: the royalty rate is now $.08 for each song, for a minimum of 500 copies, which would be $40 per song. Amos, not sure what you're looking for in terms of "clearly free of encumbrance." The CD I sent you has 6 original songs which are "clearly free of encumbrance." The 4 with songwriters listed other than myself and Frank have been paid royalties by me for my own mechanical rights ($37.75 for 500 or fewer copies), and the 5 listed as traditional are ones I BELIEVE to be traditional based on a good effort at researching the titles. You are free to use any of my 6 originals on the Mudcat sampler, and I BELIEVE you can use those listed as traditional. The other 4 would need to be paid a royalty.

Since there was some discussion about which tracks you would use, it would probably be helpful to list them again before you finalize any of the "flowers."

You've really taken on a pretty big job, and we all thank you, thank you, and can't wait to hear some of it!

OK gang. We are gonna bite the bullet on this. We gotta!

I will be publishing a list sometime late this week of any songs I have not identified as clearly free of encumbrance. Namely: indisputably trad, public domain; written by singer; written by someone known to singer who has confirmed permission; or, already licensed for this purpose.

Lemme say that if I had the dough to spare I would shell any costs out on this as part of my own contirbution, but I do not. This leaves with the following options for any item not yet in the clear:

Choice 1. Remove it and replace it with a known trad or otherwise unencumbered song. This option must happen, if it is chosen, within a week of my getting out the list (if I already have an unencumbered alternative from you I will use it, so no worries there. If I don't have an alternate, it is up to you to send me one superquick if you want.)

Choice 2. Get permission from the author.

Choice 3. Pay for the license for the minimum run -- an outlay of about $42 bucks, if I estimate right.

Choice 4. Remove without replacing.

I will take care of (1) in any case where I have another option such as multiple songs fromt he same person.

Otherwise you will have to decide which of 2, 3 or 4 you want to exercise.

Bear in mind that in some cases, the arrangement is what a copyright is on, not the words, and in that case we can argue that this is your arrangement, assuming there are some substantialdifferences. So in some instances we'll find an out that way, eh?

I am open to advice and suggestion on this, guys. This are the choices as I see them. If you find a weasel hole that won't put anyone at risk, I'm all ears! :>)

More later after I have done a sort on those known to be in the clear or questionable.

MUDCAT CD CONTRIBUTORS:

I have been plowing around trying to figure out what to do with the few cases where a song has been sent in (for the CD series) which is actually under copyright.

The situation appears to be very simple. You can go to BMI.com at http://www.bmi.com/licensing/ and learn about it, and from there go to Harry Fox to find out about royalties for the licensing which they can provide.

To have a licenseable song burned on a CD costs less than a dime. They charge two bucks for the paperwork. You can do it on line with a credit card. Information is here. This assumes 2500 or fewer copies being solld which I think is a safe bet in our case. They don't seem to have any special provisions for non-profits.

Anyway, if you have a song on the selection list which is covered by BMI and HFA would you take the time to scrape up $2.10 more or less and get HFA's approval to use it in the Mudcat CD series?

If you can't do this, and your song is not a genuine trad song, let me know, please and we'll try and handle it some way, ok?

I hate to dump this on you but I can't take this all on myself in the time it needs to get done in.

The good news is that Dick Greenhaus has offered to handle the logistics -- a real hero!! --at cost. Burning from master, copying and stuffing inserts, and shipping.   So that hurdle may well be out of the way.

I will try to get out a list of songs I am not completely certain of being traditional or written by the singer or already allowed by the known author personally.

We'll manage, don't worry.

I am open to suggestions about any other path through this issue. This is the one I have found so far. Anyone with more experience than I have in these matters, your help and.or wisdom will be welcome.

Another brilliant stroke. I was mourning the fact that I wouldn't have one of them professional lyrics printouts inside each CD.

One thread per disk with a list of the included cuts at the top, then, with each artist prociding apost containing lyrics and any history or comments on each song they have on that disk?

I like this. What an amzing thing a group thought-storm is!!

I'll put them out one thread at a time as soon as I have confirmation the inclusions are all in the clear as regards permissions.

Hmmm... yes, I think a "lyrics thread" would be a grand thing. Whenever Amos compiles a songlist for each colored CD, it would be great if each artist put the lyrics to his/her song on a thread for that particular colored CD.

Well, Orchid, Plum, what difference does it make whose on which flower -- it's just some way to get all the cuts onto one or another disk. Let's not start with which one is which -- if I could I'd put them all on one CD and built in an automatic sequence scrambling routine so it would be in random order! :>)

When I have all the disks defined I'll publish the whole list of disks in aphabetical order with the proposed tunes. OK? Won't be much longer.

Meanwhile, if you have a song on one of 'em -- just check that you either wrote it, or that the author is a friend who is happy to let you use it OR that is actually a Trad tune -- one way or another, not at risk of copyright issues, okay? We may hate the state of affairs in the copyright arena, but right now we gotta live with it and I am unwilling to put the Cat in any risk after busting my but to help it thrive, if you see what I mean! Thanks very, very much for all your help!

A new thread JUST for liner notes, so people who wish to can print it out to give along with the CDs if they give them to people who don't live here 24/7. Let the people post their own notes there, links to websitres, and so forth. You would start it with an explanation for the non-Mudcat-habituated public on how the project came to be, and how the CDs are a fundraiser and not to be copied.

Well, for my part, I intend to have the master series burned by Thanksgiving; so if the management stirs brightly, we might be able to ship them for Xmas gifts.

I would like that very much! I have a few otherprojects to move on when this is done. I want to assemble a CD of songs from the Mudcat Songbook, Challenge threads, etc. And I have a long-ago promise to record all the songs I know, for family members. And oh, yes, that darned book....and...

I am just now assembling the "Plum" CD and it is Plum loverly, pardon the expression.

Susan, as usual your brilliance cuts through the fog.

I think the earlier thread shows all the preferred cuts, except for a few later arrivals.

MUSICIANS: If there are any comments on provenance, arrangement, circumstances, aestthetics, idiosyncracies, naughty bits, or subtle overtones that you want added to your songs, please post them here, or PM me or email me with them, ok??

ALSO: Performers are going to have to be responsible for assuring me their songs are either Traditional, Written by Singer, Personally Permitted by Author, or otherwise free from encumbrance as regards permission. I have PMd a few of you about questions on this point and am adding a field to the local database to make sure we know we are covered on all cuts. Like Band-aids, man.

Joe seemed it would be all right if I created a new thread in this series under the justification of literary merit, and we have reached a Great Dividse in the phases of this project, so here you are best belovéd folkies.

I am happy to report that I am listening to the very first Mudcat Compilation prototype master CD as I write. It is absolutely great, especially with the volume turned up high!! HArvey, Rick, Kendall, Justapicker and a score of others just shiver my timbers, I'll tell ya!

Here is where we stand int he project, then. There will be five or six disks in the series. Their working names are:

Mudcat CD - Orchid
Mudcat CD - Plum
Mudcat CD - Rose
Mudcat CD - Strawberry
Mudcat CD - Violet
Mudcat CD - Aqua

There is no significance to the names except to identify the separate disks. They have no special sequence, no prioritization of importance between them, and no special categories to them. They are just five or six CDs representing the incredible talent that haunts these threads from all over the planet.

(This is intentional so people don't whine about which disk they are on!:>))

I have some minor tweaking to do before I can declare the first CD master ready. Then it is a matter of shuffling and assembling the others, one at a time, putting each one to bed with a locally burned master.

This is a matter of juggling different kinds, qualities and types of material trying to compose from the various songs a smooth-flowing series on each disk.

Pene Azul, the Silent Hero of All Things Mudcat, has offered to look into and debug the dialog regarding logistics and production methods that Max and Dick were reported to be having.

I will provide the program listings to the artwork crew shortly for the first disk, so they can finish the inserts for it. As the others are mapped out and mastered, I'll provide listings and notes for each cut on each disk.

The mechanics of sleeve literature has to be ironed out, but it depends on how we produce 'em. Full jewel cases are slightly more expensive than the thin flat sleeves for CDs but then how do you do the written material? All in due course, naturally.

I just wanted you all to know that having the first prototype master burned is a major mielstone and I am very happy with the results so far.

BTW, the sound on a CD player is much better than the same disk being played through a computer with excellent speakers. Anyone got insights as to why?

SO there ya go!! We roll on from dawn into bright blue sunlit morning skies on the peculiar life-cycle of this project, which began, believeit or not, only last March as a glimmer of an idea in a thread, and has gathered inertia since then! Hopefully, we'll poull outta town at High Noon just like Gary Cooper! (Or was that Jimmy Stewart? One of those folkie types, anyway....)
