BS: med consent advice

I was recently assessed for a new wheelchair, to be paid for by a fund.

The fund admin asked for a report from the suppliers OT, this person was asking all sorts of personal questions, I realised that she was carrying out an actual examination/assessment. I stopped it and told the OT she did not have my permission to go any further, she insisted she could get my medical records, I know she can't. I said I did not consent to her examining me in any way, she told me she was asked to do it and she will finnish it any way.


I have not given my consent in verbal or written form, the OT was not NHS, but acting privately, she refused to hand over her report conclusions, so part of my medical history is in a w'chair suppliers, sensitive info such as my condition how it affects me,medication etc. and this person will not relinquish it.

Any help would be appreciated. What laws can I quote to enforce my request. This person is not an NHS employee.

Ask about the provisions of the Data Protection Act at your local Citizens Advice Bureau, The OT are holding Personal Data about you without allowing you a chance to check its accuracy, or satisfying you of the need to gather or hold it or the security measures they intend to use to keep it safe.
I am Fairly sure that they can NOT do this without your consent!!

I am not fairly sure, I am certain they can't do this. Why didn't she go through wheelchair services who would already ( presumably) have the info she needs?

Thanks all for your advice, I do appreciate the time you have taken to respond.

The OT told me yesterday that the report was not typed and it would take a couple of days to do so. Today her regional manager told me that the report was typed and sent and that they had not kept any records. Their contradicting each other has not assured me in any way.
