Subject: Palm Tree Sesh Suspended by PEL Cops From: GUEST,MC Fat Date: 10 May 04 - 04:44 AM PEL cops appeared at 8pm on the night and read the landlord the riot act thretening him with fines unless he buys the licence at around £700. For those who haven't been to the Palm it's a small off street boozer and the sesh is popular. the landlord (Little Dave) was devastated he's trying to sort things out but in the meantime in deference to his licence we've suspended the sesh and are seeking advice. |

Subject: RE: Palm Tree Sesh Suspended by PEL Cops From: Dave Bryant Date: 10 May 04 - 06:29 AM I think that many councils (eg my own one - Greenwich) are desperately tryng to get PEL revenue before it is cut off by the new act. The guidelines for the new act seem to make it very difficult for councils not to grant an entertainments licence for free if the pertinent box is ticked whent the first (Pub) license is applied for under the new act. It seems to prevent LAs from insisting on structural changes first - arguing that if the premises are safe for people to drink on then they should be safe for entertainment as well. It will be possible for them to impose restrictions pertaining to any nuisance that the entertainment might cause, but if the entertainment is within the small events clause, ie unamplified and under 150 people even these restrictions would't apply. Mind you it might be difficult to describe McFat as a small entertainer ! In some areas, the "PEL police" appear to be freelancers who get some sort of commission from the local authority - you can be sure that they're going to try and grab every penny before this nice little earner disappears ! Try and make sure that your local landlords know about this, and do try and persuade them to tick the entertainments box, when they apply for their first license under the act - it will cost them money if they apply for an entertainments license later. |
