Yeah, that's pretty typical. I used to work at Ellis Island as a historian--the medical checks could be rigorous if they thought you were hiding something.

Sometimes the doings of bureaucracy really make your skin crawl, and this is one of them. Except it's not really just the bureaucrats, it's the politicians who have the power to cut through that stufff, and don't.

And then they yammer on about "family values".

It's a hard thing in this case to know whether to depise the Australians bureaucrats and politicians more, or the Americans.

I would think the best chances are that the media in the States will recognise this for a powerful story, and that they can start a bandwagon that will shame some powerful politician who is running for office right now, so that they climb aboard.

I see that one of the links on Cindy's website is to the Managing Editor of what I take to be the local newspaper, the Reading Eagle - here is the paper's online edition, with a number of addresses and such.

I don't think letters from over here in England would be much help, but maybe if people living nearer had a go, it might help give this story the legs it deserves, and get it some wider media attention at a time when politifians are feeling particularly vulnerable.

(Also, I have fought for years to get the designation "mentally retarded" removed from every and any assessment document to do with one of my daughters. In every school for which I have taught, it was called "Special Education" when I arrived and "Special Needs Education" by the time I left. Get the 'retarded' re-labelled. Call it what it is--find another name for Jessica's condition.)

I find this appalling. From what I understand about US immigration, yes, she could sponsor him as her legal husband but in this case he has a black mark (overstayed his visa, I think, or something like that) and they are turning him down. And it's terrible that Australia won't let the mother and daughter join the husband. This is obviously a family and they should be together, whatever the case.

Wait two weeks and the politicians are all back in their jobs again, one way and another, and they lose that sense of urgency that is associated with being up for election, and involves being worried about stories in the paper that might show them up as gutless and heartless.

Now is the time to push as hard as possible.

we hired a attorney here to write a appeal (even though we have a lawyer he can only do the legal stuff he can in no way try to put pressure on the government to do anything) since i have been back i have written endless letters and have made phone calls i have written to every senator and congressman that has either sponsored or co-sponsored any type of immagration bill in the bast 2 yrs. i have written to the president, vice president every presidental candiate, secretarty of state powell, to channel 10,15,69,15(these are the stations we get here) the governer , readding eagle news paper, federation for american immigration reform,lutheran immg. & refugee services, american civil liberties union,oprah winfrey show,montel williams show,maury show, INS(immigration & nationalation service) ombudsman khatri, att. general ashcroft, rev. jesse jackson, LIRS (this is suppose to be about childrens rights),ACLJ,ACLU..the only responces i have received beside there is nothing we can do it from cong. trent franks,senator arlen spector and congressmanjoe pitts and all they say is all we can do is to see where in line the paperwork is and how long it will be before a decission is made and they cann't even give me a answer on that..i talk to brian ant cong franks office and nicholas at pitts office but they are little to no help...since we have been back i have letters from drs. counslors, teachers, social workers stating that jess is in crisis..that her mind can not take nor understand what has happened..and if something isn't done she will crack and have to be put in a instituation..which will end up being perminitt that this is a medical emergency and that jess is in crisis..*crying* sorry i can not let this happen..in essentce the government is trying to make me choice between my husband who is the love of my life and my daughter who is my life...this goes beyond *hardship* that they say we have to prove this is *inhumane*

More info...they have denied Russell's application once so we are appealing that decission right now our appeal is before the AAU(adminastrative(sorry my spelling sucks)appeals unit) there is no way to contact them directly that i have been able to find you have to go through a senator or congressperson and they can contact the AAU...sorry i cann't think of all the info at one time...my mind is rather scattered lately...

I will tell you and i do understand that they cann't do everything for everybody..but the fact is that the government has given people with disabilities certain rights...2 of them are that they have the right to live and be educated in the *least restrictive environment* i have medical reports and reports from teachers and social workers that agree that she is so traumatised by the seperation from her father that if it is not rectified soon she will have to be instutionalized and that WOULD NOT BE the *least restrictive envirorment* so by the government not allowing her father to join us here the government is ignoring her rights so there for it is the governments FAULT.

Strikes me that even from the point of view of trying to save the US Government money, letting Jessica's father in makes a hell of a lot of sense.

If keeping this family divided means that Jessica isn't able to live an ordinary life as possible out in the community, that is going to cost a whole lot more money. I think most people would see that as the least important reason that would be a bad thing, but it's a pretty good knock down argument for anyone who sees monetary cost as the deciding factor.

I think those of us who have close family members with the kind of difficulties Jessica has can probably appreciate pretty clearly what a terrible thing has been done to her, and continues to be done to her, by the bureaucracies of the two countries involved. I hope that as many of us as possible will find a way to bring this to the attention of people who can undo the damage.

Sadly, I do think it's likely that your problem is going to be lost in the shuffle with the politicians running in the coming elections.

If it's possible to wait until the smoke clears sometime after November 2nd (and it is going to be a very messy right after that day) it might be to your advantage.

Once we know who is going to be running the country, it might be easier to gain some attention for your situation.

I really do think that the chances are better for you if you can interest the media in any way possible. Like it or not, it's the media that now holds enormous power towards which people and what stories get attention.

The last thing I'd like to suggest is having to put your child in the spotlight at a time when she and you are already under so much pressure, but I do know how these things often work in the States, and if you can get a journalist interested in your story, you might be able to put some public weight behind your request for a visa waiver.

The one thing that Guest US said, which is true, is that the government has a lot on it's plate. You need them to start to have your story take up enough room on that plate for them to act.

He says that as the Queen is - officially - the Australian Head of State, she has the authority to over-rule them on a matter like this. Perhaps it's a long shot, but it can't hurt to try... I don't know if it will help at all, but I have a personal contact at the Maury Povitch show, or at least last time I heard from an "adopted" daughter (one of my girls' best friends in school) she was still working as an assoc. producer. I will see if I can reach her and ask her to take a look at this.

I used to be an op/ed writer. Wrote about a few other "horror" stories similar to yours, one even included an Australian father who was deported back to Oz from WY. The government seems to move very slowly on such matters, but many voices can have an effect. May we all raise our voices in support of Jessica and her parents.

Uncle Sam - Cindy's already explained that Russell had had to leave the States because he'd over stayed his visa, and the family were planning to live in Australia; then the Australian authorities decided that since Jessica was disabled they didn't want to have any future responsibility for her, and the fact that she had been born in the States gave them an opportunity to get rid of her. And now the US authorities won't allow Russell to immigrate because he broke the rules last time by overstaying his visa.

MGrath, I read the website and what I got from it was they left the US to live in Australia. Australia would not take them so they moved back. Then the husband's Visa expired.

Noone has even suggested that Russell is a US citizen. Of he had been obviously there wouldn't have been any problem in him overstaying on his visa? US citizens don't yet need visas to live in their own country.

He's an Australian with an American daughter, who isn't allowed to live in Australia because of her disabiity and the Australian authorities, and he can't come to join her in America because of the American authorities.

GUEST,US, visas expire sometimes for any number of reasons, and the person who holds the visa doesn't always have any power to prevent that from happening. It's the responsibility of the visa holder to leave the country before the visa expires (if they have not been able to get it renewed), but it's not always an easy thing to do. US immigration law is a very complicated thing, and there's just no way you're going to understand it here in this thread, so you might as well not even try.

In essence the government

Next, forget about the Oprah and all the other publicity/TV stuff for now, that is stuff is strictly entertainment, and for every hard luck story that gets covered, there are literally thousands that donÕt--you canÕt afford to invest time in long shot stuff when there is other, necessary work to be done--

Next, follow up with your congressman and Senators, make phone contact with the person from their office that responded to you, and keep them up to date on what is happening--donÕt expect too much, too fast, from them--but keep in mind that, when you have all your ducks in a row, a letter or other inquiry from them can make the difference--

Next, go back and read every letter that everyone sent to you--there may be some information or offers of help that you missed on the first reading--

Next, hunker down and get ready for the long haul, because these things often take a while to resolve--get your daughter into the programs that she needs and is entitled to for her special needs--and forget this kind of thinking:

ÒRussell's continued absence is likely to be so devastating to Jessica that she will be institutionalized where she would be cared for by strangers, and not her parents. The effect of this would be permanent, and it would certainly seal her fate.Ó

It isnÕt true, and it isnÕt going to happen unless you make it happen--I know the situation is difficult, and not the one that you want, but kids have a greater capacity to adjust to difficult situations than we give them credit for (they are actually a lot better at it than adults)--just hand in there yourself, and sheÕll be right there with you--

This is my first exposure to Cindy and Jessica's problem and I haven't had the time to fully digest it but I must remind people that her problem is NOT THAT UNUSUAL. You'd think the U.S. would want nice, english speaking folks from Oz or England to come join their married families but due to the fact that the rules vary for potential immigrants according to what country they are from... it's never a simple case of "oh well, why did you overstay your Visa?" Often, people have applied for extensions, hearings are set but those hearings are scheduled for AFTER the expiration date and so on. Do you leave and not wait for the hearing, wait but be in technical violation, etc? I've had several friends with spouses from England, Ireland and Australia face this problem and it's never simple - even when no violations have taken place.

This Family's problem is NOT merely one of Immigration law it is one of Human Rights and I shall take a little time to try and gather some links for them to Mental Health Advocacy groups who might be better equipt to argue her child's case. Since the issue seems to be getting her hubbie HERE..perhaps the people who put her in this position in the first place, The Aussie Government, might have a vested interest in trying to help Russell Emmigrate. After all, if they didn't want his daughter, perhaps they'll help him join her in The States.

For whatever reason Russell overstayed his VISA...in the post-9/11 wolrd.. that is considered reason enough to make his family suffer, I am afraid. However, I think if the right people really hear this woman out, they will do what they can for her.

At the very least, I'd like to see this gal and her child get some much needed support from organizations designed to advocate for children such as her daughter. They are so isolated right now.

I'll be back with some links , hopefully later in the day.

    I have been following this thread and have read your website. Not meaning to sound rude or ignorant, but why is it exactly that your daughter may need to be institutionalized for life if her father is not here? Also, what kind of medical therapies has she had to reduce behavior issues? I am assuming that if her need is severe that medical treatment has been required. In addition, how often does Jessica talk to her father on the phone? What is her behavior like after she speaks to him?

If Curious Stranger would register as a member it would be possible for this kind of thing to be discussed by PM, which might be more appropriate and less intrusive.

But the judgement that this is what might happen, if things aren't sorted out, appears to be that of a number of professional workers who are involved.   And if you think that kind of thing doesn't happen, Curious, perhaps you do not haver much experience about the way services are all too often organised, or about the impact of stressful circumstances on very vulnerable people. Which makes you quite lucky really.

From my perspective, I see a woman asking for help in a public forum for her daughter. In order to attain appropriate assistance more information means more power, power in Jessica's corner. How is one to find help without all the facts?

My identity really is of no issue. I am a respectful individual who has enough insight (and time spent here) to know that certain people become defensive quickly. My intentions are good and prompting towards further exploration of options for Cindy and her family.

Of course there is red tape, and lots of it. I am simply curious, especially the comments about lifetime placement and what road has been taken that would end with this option.

Welcome to the Mudcat Curious Stranger (nice Mudcat name), and thanks for not being huffy about joining. Sometimes people do get uptight when advised to join, and feel it as a kind of pressure. The full details will already, of course, be with the people who are tasked with making the decision on the appeal for Jessica's father, Russell Worrell, to be allowed to join his wife and daughter, who are living in the town of Reading in Pennsylvania, after having to leave Australia 10 months ago, because the authorities there refused to allow them to stay, because of Jessica's diagnosis, and the future care implications. The reason given for Russell's immigration problem is that when in the States previously, he overstayed his visa.

And we know from Cindy that the various professionals involved - doctors, teachers, counsellors and social workers - are concerned that the enforceed absence of her father is having a serious effect on the mental and developmental welfare of Jessica.

I'd say that is enough to enable people to write letters advocating on behalf of the family, and to motivate them to do so. If Cindy feels that more information would be helpful, and would not in some way cause difficulties, she will no doubt post it.

PLEASE Re-Consider your current thinking. You are "trapped" in an emotional-box. Look outside what you percieve as limitations. You are stuck on "only one solution" to a "problem" that could offer multiple opportunities to the child, yourself, and the spouse.

Go to another UK country....they all have socialistic medical legislation, and are required to provide services to even ill-legal-immigrants. I would suggest Canada or New Zealand.

Move to China.

Have you considered some of the South American countries...ie Peru ....live transition into Bolevia and return the same day.

Focus on your, and your spouse's, positive attributes - create a resume - sell yourselves to a Russian corporation with health benefits.

In short - leave the U.S.A. - we have enough free-loading - blood suckers - (it doesn't matter the color of your eyes or skin) enough is enough!!!!

There, Gargoyle, I have reiterated. However, I think you wanted me to restate that as opposed to repeat that.

It makes good sense to keep a family together. The law which is being enforced concerns a visa overstay. In the grand scheme of things that's not a really big deal. I know it is wrong, but hell, you live in a country that has had mass pardons for people who have entered the country illegally. Look at the following site:

The problem, LilyFestre, is that if Jessica's condition continues to deteriorate because of her father's absence, there is a real possibility that she will have to be institutionalized, possibly permanently. If Cindy and her husband can't afford the cost of institutionalization, the public will have to pay for it.

Cindy and Russell would much rather care for Jessica themselves at home, and that is why they are working so hard to get the family back together again... to prevent Jessica from requiring institutionalization, and to keep their family together, as it should be.

The only stone I can think of that may be left unturned is medical. Try to get Jessica's situation reviewed by as reputable a medical body as you can. Local universities or training colleges come to mind. If you can justify and rejustify the medical link - post some medical opinions on your website - you might lend more authority to your plight. Also if your husband has a job waiting for him, get a letter from the business that needs his skills.

Try to show a complete web of success except for the missing piece of red tape. That will improve the appeal of your case - everyone loves helping success.

Listen, I haven't said that families don't belong together or anything but when someone makes such a statement about the taxpayers paying for her daughter's care one way or another kind of ruffles my feathers....and THAT is asking for money, even though it is indirectly. I think that those who legitimately seek help is vastly different from those who feel "entitled." Yes, there is an entitlement (by US Law) and I personally feel that help is a grand thing....it's the attitude that is bothersome to me.

My sense of it was that Cindy was looking at the whole situation, not asking for money. The scenarios where a single mother cannot take care of a challenged child all by herself are many. Reuniting a family to give it more resources to take care of its own seems like good financial policy for the government. I think that is what was intended.

Institutional care might last for the next 80+ years and it is certainly not a mother's wish for her daughter. Everybody wants Jessica to have the best chance at happiness including the country that calls her citizen.

    Aren't you curious about why it is that she would have to be institutionalized? I see that someone asked about it and personally, I am curious too. If her mother has cared for her for over a year now without the father, the rate of decline is what? I would think the initial trauma of Russell not being there would have been incredibly difficult for both mother and daughter...but with the passing of time and getting accustomed to a new routine, how does that end in institional care? I'm a bit confused I guess. I'm not suggesting that the separation is easy for anyone involved in the situation....not at all.

LilyFestre, Cindy and I have been in contact via e-mail. I have some information about her situation and Jessica's. I am trying to help in the ways I am most able. I understand your feelings, but I think that they are based on a misunderstanding about the post of Cindy's that you are having a probelm with.

I know that you have been in a similar emotional state to what Cindy is most certainly experiencing right now. I know that you know it is possible to reach a level of dispair and stress so great that not everything you say comes out the way you would want if you were not under so much stress. I have had such experiences myself, and I definitely know what she is going through emotionally. Because of that, I choose to not be judgemental if, from time to time, she expresses herself in a way that is more emotional than reasoned.

   My situation is nothing like Cindy's. I am not judging anyone, only trying to learn more. I have spent the last 10 years of my life working with children/families in crisis and was interested in knowing more in order to further assist.

   Yep, the comment regarding something along the lines of too bad...your tax dollars are going to pay for my daughter's care unless I get what I want...sat wrong with me, and frankly, it still does.

   It's of no matter. She is right, the US government will pay for whatever her daughter needs and that's fine.....it's well deserved....the attitude is what sticks out more than anything.

CarolC, I have to say once again, that Veronica's situation couldn't be further from what Jessica is going through. One has parents who love her and want what is best for her....the other just doesn't. I could go on, but what's the point?

LilyFestre, I didn't say that Veronica's situation is anything like Jessicas. What I said was that you have experienced a similar emotional state to what Cindy is experiencing. My own son's situation was not the same as Jessica's, but my emotional state was pretty much just the same as Cindy's.

The emotional state is the pretty much the same for all of us when someone we love beyond life is being threatened by forces over which we have no control. The feelings of helplessness, the feelings of isolation when there is no help to be had from those who are given the job of protecting children at risk, the feelings of abject fear for the object of our love, wanting to be able to do something about it... to fix it, and not being able to do so. The feelings are the same, even if the circumstances are not. I know this from my own experience.

I have to say that I find myself a bit confused about the heat that this thread has raised.

After all, as far as I can make out, Cindy is not a Mudcatter but rather someone who has been pointed in our direction as a (dare I say it) lobby group that may further publicise her predicament. OK, as long as we recognise that as what it is.

I am an Aussie with absolutely no time for the current Government & it's policies re the admittance of "boat people" etc but it has to be said that anyone seeking residence in Australia is naive in the extreme if they do not make themselves aware of what the current policy is. Similarly, anyone overstaying their entrance visa to the US in the post 7/11 world is plain stupid. I have a daughter who admittedly is now adult but I cannot imagine I would have been so short sighted as to have placed her long term welfare at such risk as is the case here.

One problem I have with modern society is the concept of "victim" & the automatic absolution of all failings if that title is claimed. The Twelve Step Group I have belonged to for 16 years suggests that when we accept that the consequences of our actions are our own responsibility we have a chance to change things.

And finally, perhaps we should have a look at a very relevant song in the Digital Tradition. It's by Tom Lehrer & called "The Folk Song Army"

If this was a tangle that involved just Cindy and her husband, I would feel much as DaveA does with regard to the adults involved. Do the crime, do the time. However, it is not just about them. There are two different things seem to be happening on this thread. There are some people who are trying to help a family in a very difficult siutuation, and a child with problems that threaten her future. And there are some people who are throwing up various reasons why they don't want to help, or why there isn't any reason to help.

So why don't the people who don't want to help, or don't think it's a situation where anybody should try to help, just start up another thread arguing that kind of stuff back and forth?

That's a serious suggestion, and one that in no way interferes with or threatens to interfere with your freedom to say what you want to. You go on thinking other people are wasting their time, if you choose to, but please don't waste your own time doing that here.

I can't be friendlier than that, can I? See you on the music threads some time. Or, if you start that other thread, maybe I'll come on over and argue with you there. But it seems to me that this just isn't the right place to do it.

Incidentally I think the title on this one might be better switched to something like the one I've given it.

I think they would probably only be starting to come down from their Election Night high.

Maybe letters or faxes (rather than emails)to Congressman Pitts congratulating him on getting elected might be the way to go - "and could you do something to help this family". From Googling around it appears that he makes great play on being be strong on family values, and I can't thing of a clearer case than this to demonstrate that kind of concern. (And if anyone wants to argue about that, go start that other thread, and we can do that there.)

And I'm not being sarcastic here - this business with Jessica and her family seems to me to be just the kind of situation where political disagreements just have no place whatsoever. Right wing politicians, in my experience, can often be very energetic in acting as advocates for individual constituents who are up against bureaucracy.

(Though I don't think that letters to him from across the Atlantic would help too much.)
