I listened again to a very distrought Grandma on the radio tonight, She said that she was deverstated that her son could no longer see his child after they had broke up, and granny could not also.

That is what happens, its a shame, but ultimatley people do have the choice of staying together and making a relationship work or spliting up. Where there are kids involved this often means that one of the parents will have little or no time with the kids, but that should be taken into account when they decide to spilt up. Life and love is not a film where we all live happily ever after once we have found Mr or Mrs Right. It takes work and commitment to make a relationship last.
If your ex's parents are going to tell your kids you are a horrible bitch who dumped their son for no good reason you may not wish your kids to spend time with them.
If your kids are not allowed to see thier father and you do not trust his parents you may not allow them to see the grandparents.
If you have sole custody of children you have sole reponsibility for them and the grandparents are after all the people who brought up their son.

You don't have the choice of staying together and making the relationship work if the other person is not prepared to try.
I know this because I was the one who would no longer try (I had tried for 14 years and I wanted the rest of my life back).

Grandparents also have rights.

They can apply for visitation privileges.

...unless of course the court decides that they are unfit as caregivers.

If indeed the mother had sole custody - or perhaps the reason is that the mother and children have moved to another state - no legal reason, just the convenience factor. again, not enough information provided in the initial post.

In fact - based on the initial post - it could be a gay couple that broke up

WHEN MAM AND DAD SPLITS UP, THE LAW SAYS THE KIDS GO WITH THE MAM.
ITS NOT ROCKET SCIENCE, but thats what happends, and it fucks a lot of people up. Some mothers are far worse than the father.
The law is such an arse, that women 'can' play on it. (Not all)
If thats not bad enough, it gives the mother years of poisoning the child against the father. While the father tries to get access. Then its too late, the damage has been done.
I know its a complex issue, but its one that needs to be addressed more fairley.
And thats just the start of the injustice, I could go on........

The law doesn't say that in Canada.

In Canada, if their is a dispute, custody is determined by what is the least disruptive to the child (depending on the ability of that parent to provide adequate care). This quite often entails visitation rights, unless, of course, there is reason to deny the other parent or grandparents, access.
