From: katlaughing Judge Rules Provisions of Patriot Act Unconstitutional By Dan Eggen Washington Post Staff Writer Thursday, September 6, 2007; 1:56 PM A federal judge today struck down portions of the USA Patriot Act as unconstitutional, ordering the FBI to stop issuing "national security letters" that secretly demand customer information from Internet service providers and other businesses. U.S. District Judge Victor Marrero in New York ruled that the landmark antiterrorism law violates the First Amendment and the separation of powers because it effectively prohibits recipients of the FBI letters from revealing their existence and does not provide adequate judicial oversight of the process. The next step, sadly, is for the case to be appealed to the Roberts (and Alito and Thomas) Supreme Court. There's a sliver of hope that Antonin Scalia will once again remember the "strict constructionism" he claims to espouse and break from the gang of three (who will vote whichever way serves the neocon Republicans and the mega-corporations). Even a possibility Anthony Kennedy may show some independent thought. But I wouldn't count on it. |
