Some copyright holders object, some don't. Some object to free reproduction of some of their stuff but are okay about others (see Paul Cranford's site for examples). In this case we know EXACTLY what Phil thinks about what you're doing. Buy his book if you're interested. I did. |

Phil Cunningham as the composer of the tune owns the copyright and so has a say over where and when the tune may be reproduced. You may have seen copyright notices on publications and they usually say something about not reproducing without permission, which it seems to me is what you have done. Don't forget that Phil Cunningham depends on his music for his living. |

If Phil Cunningham chooses to publish his own material via MySpace or anywhere else, that's his right; though I see no obvious sign that he has included notation for 'Miss Rowan Davies' or any live performance of it there; or that he intends to. Perhaps I just haven't spotted it. In any case, that still wouldn't make it ok to reproduce the material anywhere else without his consent: a link would serve perfectly well. 'GUEST,Johnmc's question, though doubtless genuine, is a reductio ad absurdam, and as such potentially misleading. 'Reproduction' in this context means public reproduction: that is, publication. Placing a transcription of a piece of music on a publically accessible website, for example, constitutes publication. The nature of the internet makes it virtually impossible to enforce copyright unless you are a large corporation, but that doesn't mean that it's ok to ignore the moral issues involved. In the majority of cases relating to folk music, the copyright holders don't mind their material being copied on websites like Mudcat provided it's done accurately and with proper attribution(s); but some do, and their wishes must be respected. The question of placing a video of a live performance on (for example) YouTube is a different one. I can't comment on the legal position, but would note that, at the very least, common courtesy requires that the person making the recording obtain permission from performer and/or venue/promoter at the time of making it; and, subsequently, for publishing that recording; though clearly many don't bother. |

The term means to copy another쳌fs work then pass it off as one쳌fs own for gain or otherwise. |

Then we moved on to other music. We agreed it was beautiful. Thanks, Phil) Last year I thought I might make a YouTube of 'Little Drummer Boy.' (YouTube had pages of warnings about not using copyrighted material, but absolutely no info on how to be legit.) After half an hour's searching, all I learned was that I had to telephone a woman in London (from the U.S.) to get permission. I decided to forget it. In contrast, bn Easter Sunday (last week) I decided I wanted to watch the old MGM movie 'Easter Parade.' I paid $2.99 through YouTube, put it on my credit card, and in five minutes I was watching it. That's what I call intelligent use of copyright. |
