Copyright info for Wade Hemsworth songs

Subject: Wade Hemsworth mechaniccal licensing???

ARGHH! Gentle Colleagues,

Larry Hanks & I have just completed a CD in which Wade Hemsworth's "Log Driver's Waltz" is included. I am seeking a music publisher who can issue mechanical license on Hemsworth's behalf. ASCAP and BMI list SOCAN. SOCAN only issues performance and synch licenses. CMRRI doesn't do anything I need it to, but referred me to a "Black Fly Music" which is ostensibly publisher of record for this song. They gave me a telephone number which seems to reach a Canadian residence. Meanwhile, back at the Prozac, I can't find any citation listing a "Black Fly Music" other than something which may or may not be administered by Southern Music (Peer) Canada. Anybody?

Egads. Just try to throw a little money in the Hemsworth family's direction!

For Canadian songs it seems that one has to negotiate individually with the copyright holder. Try contacting Ian Robb or Shelley Posen who might know more about how it works. Which may or may not be how it's supposed to work. Sorry I can't help more.

Does anyone know how to pay for copyright for Wade Hemsworth songs..probably will have two. I went through a copyright search agency and they had old information but no current information.
I am sure someone recently must have recorded log drivers' waltz and has the info.

Looks like Peermusic has the rights to "The Blackfly Song" and a few others, so that's a good place to start. Peermusic lists a song titled "Log Drive," and I'm guessing that's the same song.

I emailed SOCAN and Shelley Posen and Borealis Records and asked them to post here. Keep your fingers crossed and hope for a reply.

This is the stock answer SOCAN issues regarding mechanical rights. CMRRA or SODRAC are better organizations to give assistance. I will pass on your email to our Communications & Marketing team too
    Anyone wishing to record and/or reproduce someone else's song must first seek the permission of the copyright owner by obtaining a mechanical rights license.
    In Canada, many copyright owners are represented by reproduction rights organizations such as the Canadian Musical Reproduction Rights Agency (CMRRA) or the Society for Reproduction Rights of Authors, Composer and Publishers in Canada Inc. (SODRAC). To obtain a mechanical rights license, please contact one of these organizations. If neither represents the song you are looking for, then you will have to contact the copyright holder(s) directly.
    Alternatively, if you wish to use another person's song in a film or television program, you will require a synchronization license for the reproduction of the musical work. To obtain a synchronization license, please contact SODRAC, however, if they do not represent the song you are looking for, then you will have to contact the copyright holder(s) directly. Please note that The CMRRA no longer issues synchronization licenses.

    Hi, Joe. Recovering from a couple of broken ribs (fell on our icy steps) and on media’s nap when your message came. I can’t say as I’d have had much to offer. I’ve had little occasion to licence a Canadian song: when I did, Ian Robb was the guy I asked about how to do it. Once done, I’m afraid I forgot his instructions until the next time. If I recall, the two organizations mentioned at the end of the thread are the right first step.

i have just about decided that i won't use songs from known canadian authors unless i know them personally or they are now in public domain. i had as i said before a very nasty experience with a woman after having been in correspondence with another family member, having gone through a professional search and paid the royalties. life is too short. or if a singer really wants to do one, he or she can procure the copyright.

Oh, don't give up yet, mg. What are the songs you want to record?
I've found that "Log Driver's Waltz" is represented by the Canadian Musical Reproductions Rights Agency, which is like the Harry Fox Agency. Now all I have to do is figure out how to get a license from them.

thank you so much. I had stupidly assumed that a song so widely known and recorded would be really easy to track. And I did go through a professional agency...but I appreciate any effort on my behalf. I will license at first 300 copies, and if it sells (this is a really small process, plus I give a lot away out of th at 300) I will reorder.

I also will probably include the White Water (also known as Log Song I believe but i will look that up ) so it would be for two songs, 300 copies each.

I do usually do at least a rough copyright search before commencing, but in this case I thought it would be a piece of cake. I also try to keep copyrights to a minimum by including songs of friends, or traditional songs, both for financial reasons (this is a bare bones operation, done mostly to spread the songs and/or group them together around a theme) and to avoid the hassel, potential of lawsuits etc. Think ahead people as to how much interest you have in going on wild goose chases at times.

But anyway, thank you all.

I got pretty good at this licensing stuff when I worked on the Rise Again songbook - and I'm willing to do it for anyone who needs help. Our publisher, Hal Leonard, already had agreements for a lot of the songs we used, but there were dozens left over that Peter Blood and I had to get licenses for. We got a lot of help from Mudcatters, by the way. We weren't always successful, and had to leave a lot of good songs out of the book, like "Flower of Scotland" and "Dublin in the Rare Old Times," because the copyright holders or songwriters refused permission.
It was really cool to get a wakeup call from Iris Dement one morning, granting us permission for her songs. She's been an idol of mine for years.

I'm afraid I have little advice to add here. Bill Garrett clearly offers the best solution. My impression is that CMRRA offers licences for recordings released in Canada, and they only offer licences on behalf of publishers they represent, which means in many cases you have to go directly to the rights holder. For a US release, Harry Fox is the equivalent even if the rights owner is not American. If the song is not on Harry Fox's radar, you're back to the direct approach. It's often a royal pain.

I have searched Harry Fox and BMI and ASCAP. I did find him only on ASCAP and I think only for Black Fly. When I went back again I could not find him. If any people enjoy fumbling around with this, I would love it if you could search again. I do plan to do what Joe says but in case all else fails I want to prove I did a thorough search. But it sounds like we will be able to make contact with the rights holder.

Canadians..dear sweet Canadians..do you not want your money I am trying to send your way?

This is so strange. I read that a nephew also named did a eulogy at his service. So are there two wades? I emailed library where wade senior last lived. No. Answer. Anyone have a phone number? I think town was Marin heights in Quebec.

BINGO!! We have made contact. Had the right email address but I think hit a spam filter. So permission is granted...good thing because one of his songs has been recorded and other will be soon if singer gets back from vacation in time...

Yes. We had good contact information but prob hit a spam filter.

And if you are used to the ways of the USA portion of america, be very aware that things are different up north and you might get involved in wild goose chases, dead ends, family disputes, orphan copyrights. I have had serious problems on each CD and will stick to my promise to not use a Canadian song unless copyright information is totally accessible and iron clad.
