BS: Is Martha going to Jail?

I am curious about the investigation into Marth Stewart and the insider Trading claims against her.
I have looked in various places but like most of the other "corporate" scandals there seems to be very little news about the situation.
I am not a Fan of the Woman and it urks me to think that perhaps the investigation may have gone away without the Public being informed of the outcome.
Anyone know anything about it?

There are quite a number of news articles at google news. I didn't read them, so I don't know if they answer your question or not.:-)

We do have a member, Guy Wolff, who has been on her show several times, showing his wonderful pottery. He also is a superb musician!

I noticed Sybil Shephard is acting as Martha in an uncoming made-for-tv movie. Should be interesting! **bg**

We watch a fair amount of HGTV (Home & Garden) around our place, and we started joking a long time ago about what the decorating shows will make over when they run out of ideas for rooms and patio's, etc.... which I think will be coming sooner rather than later (boring!!!)... so we figured it would be "This Tiny Concrete Block Space," with tips on personalizing your jail cell. (They have already done some very cute dorm room redo's on realistically tiny budgets.)

Can't you just see it?

So if Martha goes into stir, it will actually happen. "Personalize your space! Take as long as you need.... there is no limit to the number of looks you can have in your cell. Remember, your environment says who you are.... And, with a little creative use of bleach, you can even adjust your jumpsuit color and pattern to your own personal style."

I have seen Guy Wolff Pottery and it is truly beautiful work.
I saw that trailer for the Sybil Shephard role on TV last week. Wonder if it has Ms Stewart's blessings LOL

The last CNN.com article on this says that the case was referred to the Justice Department for investigation for possible prosecution last September...that should guarantee that nothing happens until at least 2004.

This is a difficult one to prosecute since it will come down to her word against that of her broker. If the prosecution can get multiple witnesses, they may pursue it, otherwise their case comes down to "if it looks like a fish and smells like a fish ... then it must be a fish" sort of thing. Not the kind of case that wins many convitcions - BUT there are civil proceedings that could be won against her, and cost her very big (remember OJ). This is what is likley to happen to Ms Stewart.

If Hillary didn't then why should Martha?

So Banjoest, are you saying they should spend hundreds of millions on Martha too so that in the end thye still can't prove a gawddamn thing? Or are you just intimidated by women who play "Old Boys" games as well as or better than the "Old Boys?"

So far, OJ hasn't paid a cent of the judgement. Civil suits after criminal acquittal are stupid and seldom successful.
Dunno if Martha is guilty or not. Always thought it funny that she could con people so easily, but she just followed the trail of Ralph Lauren and so many others. Maybe Emeril will be the next in line for the easy pickin's. He's a cook? Now, that's funny!

Sibyl is sympathetic to Martha's response regarding the insider trading. She points out that many men have had a bare slap on the hand for far more provable infractions of the code regarding insider training. The blurb about the Stewart movie says that the book was unauthorized. I suppose that would make the movie the same. Only reason it can go forward is because she's a public figure, and thus doesn't have the same protections a private individual would have.

I don't know about her temper, which seems to be the main feature of the movie, that she has one and doesn't show it to the world on tv. Well, duh.

I don't quite understand why Martha can't get advice from her broker..or is it a crime just to know people who are in the know ?

Sign in front of a storage unit place, not long ago (they change it regularly; always topical):
"Martha's cell would look so cute."

Jim and Tammy stole from elderly folk who weren't gambling with their money... they were outright crooks of thge vilest nature.

But did Martha "steal" from "persons" ? Jim and Tammy took the life savings of people by cashing their cheques for nothing in return. Heartless fraud against people who could ill afford it.

Perhaps I just don't understand the depth of what Martha did. I'm just a poor old country boy from the backwoods of New Brunswick. To me, high finance is getting a 4X4 rather than a regular pickup.

I am not sure Martha did anything wrong. But dishonest stockbrokers steal from people, just in a subtler way. I know what you are saying about Jim and Tammy is true..but theft is not who we steal from, it is that we stal at all..isn't it ?

Insiders who trade on knowledge of the sort that allows them to take their money out "in time" ARE taking money from others--those who also invested who don't have that advance knowledge. Catching the people who do it to enrich themselves seems a no-brainer--they did something wrong. The tricky part (as discussed above) is whether the fellow in the know who alledgedly told Martha to sell has implicated her in his crime--what exactly did he tell her? "Time to sell" isn't the same as "You have to sell because the bottom is going to drop out of this company the day after tomorrow." She says she had a standing order that if her shares dropped below a certain point, they should be sold. Lots of people have that kind of arrangment (or so it seems--I listen to the Motley Fools on NPR on the weekends, and what I've learned there would support this notion. And BTW--the Gardners like Martha and her company).

Appropriate that Cybill (got it this time!) should play Martha. They both started out modelling and have had quite varied careers from there. Stewart was a stockbroker for a time (hence her understanding of the market and placing orders in advance to sell, etc.), a caterer, writer, television personality, all of that stuff she does now. Cybill has added acting, singing, and writing to her resumé.

As to the anger (that I mentioned above) being a feature in the book and movie about Martha, in the blurb I saw, she was angry about lima beans not being put in place. I could never get angry if someone didn't supply me with lima beans (vile things!) but I can understand her frustration if someone opened too many bottles of wine at once. Anyone priced good French wines lately? ;-) This isn't exactly Martha Dearest.

What are her alleged crimes when compared to the travesty of Silverado, Enron, Arthur Anderson, et al? Did Jeb Bush get a nice cell, not! I don't wish her ill, good gawd, who is she to me that I would do so? The rest of those I just mentioned, yeah, because they did hurt thousands who placed their trust and working lives in their hands and they screwed them.

From what I've seen of the previews, it looks as though she got pissed at her husband's mistress and at an incompetent employee. Who among us has not blown their lid under duress at times?

I know that she has been a good supporter of Guy Wolff and his pots and he's said nary a word against her and that is good enough for me.

I've often wondered if they were maybe making Martha a bit of a scapegoat as a way of taking some of the public's attention away from Enron, Arthur Anderson, et al.

Here's something really cool I found in the Guy Wolff site that katlaughing linked to:

That may be the case Carol.
I have wondered myself about the reasons behind the spotlight on this coming around the same time as many of the Corporate corruption Scandals.
As I said I am no fan of Ms Stewart's TV shows and I also have never warmed to her Public Persona but as I do not know her personally I cannot comment on her character. I do feel however that the Media was quick to put her on trial Publicly but not too fast at bringing any of the news relevent to the investigation afterwards.
Regardless of who you are it is only fair, I believe, to inform the Public of the full story after it has been brought to their attention in such a sensational manner. Sound bites and Sensationalism without substance can be very damaging no matter who you happen to be.
I have no pre Judgement on this particular case, only an interest in the outcome now that it has been drawn to my attention.
I am sure it would also be in Ms Stewart's interest that if no evidence is found that it be made public.
The accusation alone must have caused problems!
It always urks me how accusations are reported about Celebs on the front page or on the prime time TV shows but if they are cleared of these accusations it isn't given the same Media attention.
Of course the same thing can be said of accusations that stick but mysteriously go away! Now that really P's me off.
As for the made for TV Movie with Cybil Shepherd I think I may just find something else to do while that's on...(yawn)...:>)

Well, when Dick Cheney gets $1.4 million a year as a sitting VP, there ain't a chance on Martha gettin' any time fir her little shop lifting of fellow investors bucks.

But now as fir her TV crap, that could get her some serious time...
