I was going to award the appropriate Chips to all the participants in Song Challenge! Part 93 before I did this one; but, this story is just too good to let pass. So, all you Challenge!rs put on your thinking caps, sharpen your crayons and roll out that TP, cuz . . .

You Can't Touch That . . . Chicken!?! -- [Murphy, Oregon] March 25, 2004 -- A Williams man thought he was rescuing a neglected chicken, but the Josephine County Sheriff’s Department saw it as stealing and arrested him early Wednesday.

Nick Gombos was arrested at 1:08 a.m. and charged with third degree theft and interfering with an officer at Gombos’ home on Powell Creek Road. He was handcuffed and placed in a patrol car wearing nothing but his underwear. He was released from jail Wednesday morning five days after he took home a lone chicken from outside Ray’s Food Place, 7200 Williams Highway, in Murphy a few miles south of Grants Pass.

Little did he know that he had driven off with Speckles the celebrity hen, and community members, not to mention Jekyl the rooster, would want her back.

Kathy Dean, Gombos’ wife, said they were not regular shoppers at the store and were only thinking of the chicken.

Dean said Gombos stopped by the market after-hours Thursday for his weekly Nickel newspaper when he noticed a chicken huddled inside the magazine rack.

Assuming it was abandoned, and could easily fall prey to animals or highway drivers, he took the hen home.

The next day, Dean said she learned that the chicken actually lived at the market, but she feared for the chicken’s safety next to a busy parking lot. So the couple purchased a companion hen and rooster, and were making a new home for Speckles. Then, she called the store and told employees she had the chicken.

"Up until the day before yesterday, everyone at Ray’s was fine with us having the chicken," said Dean.

Community members were becoming concerned about the store’s hen in her absence, and soon the store’s staff filed charges. Josephine County Sheriff Dave Daniel said chickens have been living outside the market for several years, and they are something akin to celebrities in the community.

He said deputies tried to keep the situation low-key, but Gombos wouldn’t return the chicken when asked earlier Thursday. So the sheriff’s department obtained a search warrant signed by a judge, a process that took until 1 a.m. They had planned to issue a citation, he said, but Gombos was trying to keep them from getting Speckles.

Sheriff Daniel said deputies asked Dean if she wanted to get clothing for her husband, but she was also uncooperative.

"So he went to jail in his red Speedos," said Daniel.

Dean said she didn’t hear a request for her husband’s clothing, and to be accused of theft is ridiculous.

"The last thing I need is a chicken," she said. "Nick’s not going to steal a chicken."

Meanwhile, Speckles was returned to the market Wednesday.

"The rooster was super excited to see her," said Nate McCully, Ray’s store manager. "He came flying out of a tree."

McCully said he grew up raising chickens and thinks the pair at Ray’s are as safe as any on a farm. He said the two chickens are not owned but live at the market by choice and are cared for by customers and employees. And, like other community members, he’s become attached to them.

"It just wouldn’t feel right coming to the store without the chickens being here," he said.

Gombos is scheduled to appear in court Friday.

Sheriff Daniel said the release agreement requires Gombos to stay away from the market.

"No more contact with Speckles," he said.

But Nick he was no villain; his intentions they were pure:

His wife began a flock and made Ray's Food Place aware
That the bird would no longer be in such danger there.

Nate McCully, the store manager, denied charges of fowl abuse.
He said, "They're not our birds; they just run around here loose."
Then he filed charges, called Nick a chicken thief!
And he didn't even own the bird! His nerve is beyond belief!

Now if you'll pay attention, I'm sure you'll have a laugh.
Nick, his wife and the sheriff conspired in a social gaffe:
Out there in Oregon, not to far from staid Grant's Pass,
You don't get arrested with only a red Speedo to cover your ass!

The sheriff says he told Nick's wife to get him some more apparel;
That's a claim with which she has a serious quarrel.
When he asked Nick in decency to cover himself -- please!
Nick took umbrage when he referred to his Speedos as -- BVD's!

Such crass disregard for upscale brand recognition
Made Nick stubbornly refuse to improve his dress condition.
So off he went, arrested, with his barely draped posterior;
Home again soon after, we hope wiser, but surely wearier.

The case is unsettled, we doubt it will go far.
The hen is home with the rooster, pecking at the parking lot tar.
Down at the Murphy barber shop, there's been palaver and prattle ,
But it seems clear that there will not be a custody battle!

He seems really dedicated and pays back 80% of all money made from downloads back to the artist. I just received a phone call from Meg Landers, a wonderful newspaper reporter at the Medford Tribune.   Our beautiful, sweet Speckles was found dead in front of Ray's Market yesterday, on Sunday morning.   I just phoned the manager of Ray's Market, Nate McCulley (I was sobbing, which is not an unusual state for me these days) to tell him how sick I was about it, and he calmly told me her death was due to "Media Attention."   He was not crying and he showed absolutely no emotion whatsoever.

This is the fifth hen that I know about that has been killed at the market.   Why the SPCA did not follow through with the paperwork I don't know, but I will be phoning them when I calm down.   I don't know if she was run over (that's how most hens get killed there) or her neck was wrung.   Meg Landers told me that her neck had been wrung, but I can't even imagine someone doing that.

I think that maybe Nick and I were the only ones who did come to love her, because anyone that cared for the safety of an animal would not place them back in an unfenced area next to a highway.   The total, complete insanity of this all is beyond belief.   When everyone hears what the police really did to Nick and to me, your shock and outrage will almost equal mine.   At this time I am not allowed to discuss it due to our lawyer's orders.

I answered a lot of unanswered questions on the Sheriff's bulletin board last night, and the webmaster, Rarey, removed them all.   I took the time to explain to people that the chicken was not "stolen" and there was no "warrant" for Nick's arrest, etc.   I assume the Sheriff Department can not handle the truth.

Meg Landers at the Tribune is writing the article.   She loves birds, as do we, and I know she will handle the story with the compassion it deserves.   I have a beautiful picture of Speckles that I took with Nick holding her, and I will post it to my website later.   Oh, I just realized they shut down my web site again, so I'm not sure I can do that.

There has been some important information that we have known about for some time but have not been able to divulge.   Since this information was presented to the DA of Josephine County today in court, I have our lawyers permission to release it.   I am first going to run down a very quick timeline of the actions that took place.

03-18-04    Nick finds Speckles in magazine rack at Ray's Market

03-19-04    Kathy phones Ray's Market to say we have the chicken

03-20-04    We buy hen and rooster since Ray's employee said to keep Speckles, bring back the apple crate.

03-21-04    Nothing

03-22-04    A lady by the name of Connie Young phones me up and threatens to bring a "mob" of people over here to "get us and the       chicken."    She also says she owns the Chicken.
                I phone the Sheriff to file a complaint for harassment.
                Deputy Tripp phones back to say Oregon has a two time threat law, and the first does not count so Ms. Young did nothing wrong by threatening to physically hurt us.
                Deputy Tripp states that Rays Market owns the chicken, not Connie Young.

03-23-04    Deputy Tripp harasses me all day by phoning and saying that my husband is going to be arrested for a Felony, and his gun and voting rights will be taken away.

03-24-04    Nick is arrested for chicken theft at 1:30AM and taken to jail.

Anyone who has followed the case knows the above scenario.   What you don't know is this:

1.    The Josephine County Sheriff's Department knew that no one owned the chicken and brought the charges against Nick in spite of this fact.

2.    Ray's Market never once phoned the Sheriff's Department to report a stolen chicken.   Deputy Tripp phoned them!

3.    The Sheriff's Department has constantly lied to the public via the media and their Bulletin Board on their website by stating that Ray's Market phoned in a report for a stolen chicken.   They have even gone so far as to say the manager of Ray's Market said he owned the chicken.

4.    The Sheriff's Department (and many other people) have constantly referred to Nick Gombos as a "chicken thief" when in reality absolutely no one phoned in a theft, or even owned the chicken.

5.    The Sheriff's Department (Tripp) lied to the Judge in order to get the Search Warrant signed at 12:05AM.   

6.    The Sheriff's Department (Tripp) lied to the Judge stating that Nick had tried to also steal a rooster.

7.    The Sheriff's Department (Tripp) lied to the Judge by stating the hen was owned by Ray's Market.

8.    Ray's Market demanded both verbally, and in writing from their lawyer that all charges be dropped against Nick Gombos.

9.    Ray's Market documented both verbally and in writing from their lawyer that they do not, nor ever have owned the chicken Nick picked up.

10. Ray's Market did not even realize they were involved in the State of Oregon lawsuit against Nick until I, Kathy L. Dean, told Nate McCulley over the phone.

11.   The Sheriff Department illegally entered our property and illegally arrested Nick.   They was no legal paperwork for either action.

12.    In the court hearing today, our lawyer, Foster Glass, brought up to the DA that Ray's Market has filed paperwork claiming they never said they owned the chicken, want no charges brought against Nick, etc.   This is legal, filed paperwork demanding that Josephine County stop bringing their name into a lawsuit that never involved them, and they never reported.

13.    The Josephine County DA stated that they will probably "amend" the paperwork and "find" an owner for the chicken, which sadly is now dead.   

14.    There are apparently no "tapes" to be turned over to our lawyer, and I know the reason why.   We have always known the reason why.   Nick did not resist arrest or do anything wrong.   All the tapes would show is their own officer ripping down our front gate.

15.    DA Clay Johnson and Sheriff Daniel have so much money that they are going after a man who did not steal a chicken, has a corporation backing him stating he did not steal the chicken, has a corporation demanding that all charges be dropped and that Ray's Market's name be removed from the illegally filed paperwork.

16.    As it stands now, Deputy Tripp illegally listed Ray's Market as the "Victim" and reporter of the theft.

17.    Had Deputy Tripp done his duty and cited Connie Young for making threats against us, as he should have, Speckles would be alive today.

18.    Had the citizens of this County demanded, as they should have, that "chicken theft" is a civil matter and not a jury trial matter, this horrible, stressful situation would not be where it is today.   

19.    The next court appearance is set for 24 May 2004 in order to give DA Clay Johnson time to find an owner for the chicken.   You think I'm joking?   Sadly, I'm not.   He stated that if he could not find an owner for the dead chicken, he would "amend" the paperwork to show a different owner.   Again, sadly I am not kidding.   

20.    I know for a fact there are a lot of "Good-ole-Boys" that will step up and say they own the chicken.   Even though it's extensively documented that the chicken just showed up "out-of-the-blue" a couple of weeks prior to Nick finding it, I will be willing to bet all of a sudden some one is going to come forward and claim they placed the Chicken at Ray's Market.

21.    Does anyone in this county care if this happens?   Nah! Of course not!   If they did, something would have been done about it long ago.   Will people phone Nick and apologize to him for the horrible things they said to him?   No, because people in this area don't care what happens to others as long as it does not happen to them.

22.    We got our ballots in the mail today.   Will the citizens vote out the crooked County Commissioners and get new faces in there?   Nah.

Welcome to the Mudcat Cafe, Kathy. I have to say that your real story is much more gruesome than I imagined, and it sounds like you and Nick are dealing with serious bureaucratic dementia in this case. What could be motiviating these poeple? Don't they have enough to do?

I hope you will forgive our making a Song Challenge up based on the news reports about poor Spreckles. Sometimes you have to laugh to keep from cryin', I guess.

Reading some of the songs were the only thing that has made me laugh in days.   If the sheriff's had not illegally entered our property (they had no legal Search Warrant or even a citation for Nick's arrest) Speckles would still be alive today.   I know she is only a chicken, but I sobbed all morning yesteday when I heard her neck had been wrung.   The DA actually told our lawyer they WILL find an owner for the dead chicken.   Ray's Market has filed papers stating they never owned the chicken, etc.    We are being threatened daily and not only worry for our lives, but the lives of our animals.   Nick is diabetic and very sick, plus a partially disabled Vet.   They forced him to walk barefoot down 200 feet over our very sharp 3/4 minus baserock driveway.   The circulation to his hands was cut off, and when Nick refused to give the sheriff the combo to our electric gate, they broke it down. They would not remove his cuffs so he could punch in the combo. They could have asked me to open it remotely from inside the house.   Yes, we are a mess.   Nick is on medication from the VA, so is actually doing better than I am.   I am, for the first time in my life, and I am 57 years old, knowingly near a breakdown...K.

Teenager admits to strangling Murphy's store hen
A Cave Junction teen has been charged Thursday with animal abuse after admitting to a sheriff's deputy that he killed Speckles — a celebrity hen who made her home at a Murphy supermarket.
Adam M. Abbey, 18, of Cave Junction was cited on a charge of first-degree aggravated animal abuse, a class "C" felony. Josephine County sheriff's Lt. Lee Harman said deputies did not arrest Abbey because he has no prior criminal record and cooperated with police investigating Speckles' death.

On Sunday morning, Speckles was found dead on the doorstep of Ray's Food Place, 7200 Williams Highway. The discovery prompted a community outcry, with a local businessman offering $500 to anyone who turned in the chicken killer.

The sheriff's office received an anonymous call with information that Abbey was to blame for Speckles' death. Abbey found out police were looking for him, and went to a sheriff's substation in Cave Junction.

Abbey told a deputy that he went to Ray's on Saturday night to use a pay phone. He said he wrung Speckles' neck because the chicken "had a limp, and he wanted to put it out of its misery," Harman said.

Abbey admitted to drinking beer and hard alcohol before arriving at the supermarket, Harman said.

I would have entered this sooner but I've been off line a lot. I am sorry about the loss of Speckles, and have to start by saying that I really do hope that Nick and Kathy have weathered this loss and abuse and are healing from both the insults and the injuries.

I will not offer an apology for my challenge effort which responded to the information available at the time. I do extend my condolences to all who experienced the emotional loss, and express my outrage at the miscarriages of justices in this case, which seem symptomatic of what's going on in America (but I hoped not rural Oregon).

Does anyone else sense a parallel to world events in this preemptive strike on trumped-up non-charges? The supposed governmental intercession to rescue an innocent victim resulting in her untimely death, not to mention torture and humiliation by an arrogant rules-flaunting teen-ager? The rousing of popular passions based on false, incomplete, contradictory or misleading information? The official sources of military/police power spinning the facts on their website? I wax wroth! Is this Deputy Tripp a relative of Linda Tripp? Wait, no first name is given -- could it actually be she? The behavior patterns are consistent!

This case should be pursued in ever higher circles. If we want justice, it should be taken all the way up to the Supreme Court, where ----- Oh, oh, ----------- never mind!

This is my first time back to this site, and I was never offended before.   But this time you guys made me cry.   I love you all.   Nick went to court yet again today, and it was again cancelled because after two months, the Sheriffs STILL have not turned over all the tapes and videos.   TWO MONTHS.   I personally think they have that at Industrial Light and Magic doing a little modification to them.

The latest is that Ray's Market never filed a complaint for a stolen chicken, nor did they ever file a complaint against Nick Gombos, my husband.   They had their lawyer white a letter to the DA demanding all charges be dropped against Nick, which of course only made the DA more determined to get Nick.   It turns out that Tripp (I love the Linda connection!) went on hearsay of that woman who phoned up and threatened us, and got the judge to sign the tainted search warrant.

I ain't making this up, folks!   Now get this.   Since Ray's Market stated they never owned the hen, plus it had only shown up several weeks before Nick picked her up, the police made up a "NEW OWNER" for Speckles.   We have no idea who this new owner is yet.
