No disrespect to all the people and the hours they have spent but does EFDSS or the Musicians Union have a an understanding or any advice to offer?

Yes. Don't ask us, though; ask them directly, or look at their websites.

My experience of the last EFDSS presentation at a festival was that their only interest was moving from London to the peoples republic of south yorkshire.

'An exemption for the performance of live music (amplified or unamplified)anywhere, if it is 'incidental' to other activities such as eating and drinking (but not dancing, or another licensable entertainment).'

This is from an MU site.

I know I am being simple minded but if people were playing or singing incidental to drinking with no intention of pleasing anyone but themselves, not unknown in folk circles, ie a session or sing around, would this be an exemption?

I tried the EFDSS site but could not find mention on it of PELs. Google offers a lot of EFDSS / MU sites and links, many that lead straight back here, but many seem undated so it is difficult to how current they are.

Is it likely that the MU will follow the development of the Bill/ Act in action?

Don't try to interpret it yourself. You'll just get confused, and confuse other people unnecessarily. The fact is that, though the apparent meaning and intent of the new law is reasonably clear now that the associated guidelines have been published, we simply don't know how it will all be interpreted locally. It will be months before full implementation, and until then speculation is pointless.

Just encourage all your local publicans to sign up for the full set of options.

As for EFDSS, their resource pages aren't hard to find. See http://www.efdss.org/licensing/index.htm.

It's background material and won't give you all the answers you want, because nobody will know, until the new law is actually in operation, exactly how it will work. You won't find definitive answers anywhere yet, though you'll find a lot of speculation; some well-informed, some bizarre or just plain ignorant (much of it here).

Of course the MU will follow developments; when there are any to follow. At present we are all in limbo, and must simply wait to see what happens.
