I have to tell you that the taking of afternoon tea is now prohibited in Whitby, Glaisdale and Robin Hoods Bay. Sleights and Staithes applied and were granted exemtions provided the tea was not Earl Grey and the scones contained local preserves and were baked in AGA ranges.

Whelks, Cockles, Mussels and Shrimps may come under the Seafood Miscellaneous Items Order and as such the licencing scheme does not come into effect until October 2007 when obiously being in possession of a clas A prawn becomes a offence which carries a custodial sentence but my colleagues in the Whitby Seafood (no Vinegar please) Police may advise more.

Offences relating to consumer information
    3. - (1) Any person who, in contravention of Article 4.1 of Regulation 104/2000 (consumer information) as read with Regulation 2065/2001, offers for retail sale to the final consumer any of the products to which that Article applies shall be guilty of an offence and liable on summary conviction to a fine not exceeding level 5 on the standard scale.

    (2) Any person who fails to comply with Article 8 of Regulation 2065/2001 (traceability and control) shall be guilty of an offence and liable on summary conviction to a fine not exceeding level 3 on the standard scale

The regulation came into force in 2000, it demonstrates how much the Whitby Seafood police are behind with their interpretaion of the current legislation

Under regulations just enforced by Scarborough and Whitby Councils. It will become an offence for someone to knowingly (or more pertanitly unknowingly) sing or perform in any shape size manner or hot pants the song which is entitled 'The Fields of Athenry' or any constituent phrase line verse wherin. Fines will be levied, tongues will be cut out, spleens will be vented and if the said singist has a mangy dog on a piece of string the dog will be taken away and barbecued.

Surely this applies only to possession in order to supply? I believe that action would not be taken over possession of small quantities (such as oakley's home-grown whelks).

Possession in order to supply a class A prawn would indeed be an offence however if the said prawn could prove it was an only child it would be let off with a caution
