I know we have a few people on Mudcat that might be able to answer this. I will be checking things out properly through other channels, but would like to see what you think.

My daughter will be at University this September for the first time. She will be 19 and hasn't been employed.

However, since August 2009, she has been on a gap year in Holland and as such is not working, so it is like being on holiday. She will be returning to the UK August 2010.

She is staying with a family and in return for them providing a room for her to sleep and providing pocket money, she does simple chores that must not exceed (I think 16 hours per week), by law. There are also very tight stipulations as to the type of things she can help with. The Dutch Law provides guidance on all of this and what the maximum amount of pocket money can be paid. She is not on a payroll and neither are the family required to do that or allowed to.

She is in fact an Au Pair which in Dutch Law, is not classed as being employed and is not insured for medical help etc etc.

We have taken out a 1 year travel insurance to cover her for any eventualities. So effectively she is in reality classed as being on holiday.

In order for her to go to University in this country (UK) she is required to have a CRB check as she is planning to go into teaching and some of her degree, will require her to be gaining experience in several Primary Schools over the time of her course.

She has to say where she is living and for how long.

Is being on holiday in Holland classed as living in Holland, or is she deemed as still living at Home?

Does she need to get a Certificates of Good Conduct from the Netherlands?

I am hoping that she doesn't have to do that as it will incur extra time.

Any help from people who know the law will be greatly appreciated.

I will tell them that Gnu said List her at at home but on holiday. However gnu is not sure of much of anything these days.

It might be worth getting in touch with one of the teaching unions, who generally have legal departments.

In touch? With any boorocracy? I would simply list her at home. If she must submit correspondance, have her do so to you and then you remail it from your address. No need for them to know otherwise.

Can of worms, innit?

I disagree Gnu, this is about her career and messing around now could blow up in her face later.

Call Citizens Advice Bureau. There must be one in Brum. There are other legal drop in centres around too that I'm sure could help.

Hi Les. I've just renewed my own CRB check. I don't think you need to go to the Citizens Advice Bureau. The form for your daughter was presumably sent to her by her University, ask them for clarification as they will have lots of experience with students on gap years. I would think that her home address as her permanent address should be adequate, but the form does ask you to list ALL adresses you have lived in over the previous 5 years, including overseas addresses. However I doubt that the CRB has the capacity to check all overseas records.

There is a useful website for the Criminal Records Bureau, with an e-guide for applicants. This tells you far more than you want to know, but if her University has asked her to complete the form, then contact the office that sent it for advice.

Seems she just has to fill our own address for the purpose of her home.

Then in the first previous address section

First line as OVERSEAS
Second line the address etc

Then only fill the date in when she went over there, but not the return date, as the form will be rejected until August in her case.

Attach a seperate letter from my daughter saying that she is currently travelling backwards and forwards between her home address in the UK and the address in The Netherlands.

All done :-)

CRB check is pretty easy - You can do your own online through http://www.ukcrbs.co.uk/ and sometimes, if you can afford to, it is worth doing it and keeping it up to date on whatver the suggested basis is nowadays.

Think yourself lucky that you don't need to do SC or DV clearance! That is a nightmare.
