FOX is certain to win unless the Agitproperties crew can attract the attention a white-knight intellectual property lawyer. Sadly, it costs a lot of money to exercise free speech in America.

"We have no illusions about the phalanxes of highly-paid attorneys that FOX has on retainer or about the time and money this case would require to fight in court. Sadly, if we cannot get an attorney to take our case pro bono, FOX will prevail," Luckett says.

I never understand how that works. I'd have thought that the mere fact that one side has high powered and highly paid lawyers and the other side doesn't would prejudice a jury against the former. Unless they dispense with juries in these kinds of cases.

Weelll...free speech costs money. Time IS money for lawyers, so you do the math. But if Fox pursues them, hopefully their local ACLU will take the case.

The Faux News is a first rate parody and Fox' lawyers should be ashamed of themselves.

Kevin, the jury part is just the tip of the iceberg -- the process of law is highly adversarial, and is bent more to victory, not truth. There are so many processes and motions available that require legal skills to prepare for and generate documents for and round up names and lists and such for, that a deep-pocket team can simply overwhelm an opponent who has little dough. The rules get turned so they don't actually serve the purpose -- but they are still the rules.

Yes, I take that Amos. But at the end of it, free citizens have the power (and the duty) to say "get stuffed" to the high price lawyers and the whole phoney apparatus. So long as there's a jury involved, that is - which is why increasingly the system finds ways of removing juries from the whole process.

I wouldn't read "Hustler" unless there was serious money in it. So, I would never have read the parody ad "Hustler" ran about Jerry Fallwell if that clown hadn't sued Larry Flint.
Likewise, the "McLibel" suit did McDonalds more harm than good.
Fox news may be doing Faux news a colossal favor by taking them to court, and giving them all that free publicity. Where can I order one of those shirts, anyway?

Well, in Juneau, Alaska, USA, two peace groups marched in the 4th of July parade,with no ill effects. One was a Veterans for Peace group, the other one a Defending Freedom group with signs that urge the importance of maintaining freedoms at home. (Defending Freedom was the ungainly slogan and theme of the parade this year. Sounds like the Bush Administration named it.)

Judging by the response we got from people along the parade route, there's no way that Bushie et al has a high approval rating. We got a BIG hand and thumbs-ups all along the route.

Incidentally, I'd like to start a push for renaming this day. Instead of Independence Day or the '4th of July', how about 'Freedom Day'? Independence means nothing if it doesn't mean freedom and it would allow disparate groups to celebrate all aspects, from gungho military types to the peace movements.

The ability to buy the justice you require is not just an American disease, forget O J Simpson. Cast your mind back to Gerald Nabarro, and also the ridiculous farce of Michael Douglas and his pretentious wife, sueing for invasion of privacy. I think that James MaNeill Whistler must have been revolving in his grave at great speed over that one.
Yes freedom of speech is a luxury few can afford.

Metchosin, the play on words is visual (starts with 'f' ends with 'x' as does the word fox) rather than aural. And then there is the meaning of the word faux, which in English means fake. The irony is all the more rich in this circumstance, because the word is also a French word, and Fox, more than any other network, fueled the anti-French campaign which has been so damaging to American credibility in the international arena.

Je comprends. I come from the land that has both French and English on the box of cornflakes. Both the words "Fedex" and my "f****ing ex" begin with "f" and end with "x" as does the word "Fumeux". Perhaps the connection is a little too "fumeux" for me. *BG*
