Ah, here's the rub. Is there ANY $$$ being generated by the website? If so, NO! If not, and credit is given where credit is due - not in fine print, but where it CANNOT be missed, not a hope in hell that he can be held to anything but promoting the original artists. Of course, I are a engineer, not a liar.

If they really want to be on the web, they can sing anonymous or trad. ballads that have no known originator.

A lot of current hip hop numbers consist of someone recording over a well known song. I'd be interested to know if the singer they're recording over (and including) in their work shares in the proceeds.

Well, it depends on the exact laws of your country... but overall

No... if you're presenting someone else's art, you are supposed to pay them for that presentation...

Technically speaking for instance, when I cover a James Keelaghan song at one of my gigs, I'm supposed to pay him his quarter-cent royalty (Or whatever paltry sum it adds up to be)... The pub where I do most of my giggling pays into some level of SOCAN though, to cover the cost of such... (And according to the owner it's only a few bucks a month or so... He tells me he has to pay by the year, or it's such a small amount, he'll regularly FORGET to send it in! LOL )

Of course, there enters into it the question... do you think the original creator is ever going to find out you gave away the mp3s? I'ts really not likely....

My husbands band has created a website and would like to put
mp3s of the songs they play. The songs, of course, have been
recorded by other musicians. The question is, can they do this?

Someone told me that if you give the original band credit
and the mp3 is of your band playing, not the original,
it would be ok.

I would greatly appreciate any help you could give me.
